AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5
SUBSECTION, 31-5.56 SETTING FORTH ZONING CLASSIFICATION
OF SAID AREA OF LAND DESCRIBED AS 18.83 ACRES OUT OF LOT
9, SECTION 5, FLOUR BLUFF AND ENCINAL FARM AND GARDEN
TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Leon Lowe, Joe
Lowe, and James R. Howze for amendment to the zoning map of the City of
Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, October 5,
1983, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "A-2"
Apartment House District, on 18.83 acres out of Lot 9, Section 5, Flour Bluff
and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully
described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.56 to hereafter
read as follows, such zoning classification of the hereinafter described
properties to be effective upon annexation:
"Section 31-5.56. The following described tract of land shall be
zoned and classified as follows:
"A-2" Apartment House District on the following more particularly
described tract:
Fieldnotes for 18.83 acres of land out of Lot 9, Section
5, Flour Bluff and Encinal Farm and Garden Tracts, a map
of which is recorded in Volume A, Pages 41, 42, 43, map
records of Nueces County, Texas;
Beginning at a 5/8 inch iron rod found at the common
corner of Lots 7, 8, 9, 10, Section 5 for the North
corner of this tract;
Thence South 61°03'37" East, along the common boundary
line of Lot 8 and Lot 9, 619.91 feet to a point on the
existing Northwest boundary line of South Staples Street
for the East corner of this tract;
Thence South 28°55'00" West, along the Northwest boundary
line of South Staples Street, parallel to the centerline
thereof and 40.00 feet distant therefrom, measured at
right angles thereto, 1320.89 feet to a point on the
centerline of Timbergate Drive for the South corner of
this tract;
Thence North 61°00'45" West, along the centerline of
Timbergate Drive 622.21 feet for the common corner of
Lots 9, 10, 23, 24, said Section 5 for the West corner of
this tract;
Thence North 29°01'00" East, along the common boundary
line of Lot 9 and Lot 10, 1320.37 feet to the Point of
Beginning.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
