Home My WebLink About17876 ORD - 10/12/1983TEXAS: AN ORDINANCE AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE ACQUISITION OF A DRAINAGE EASEMENT IN CONNECTION WITH THE MAIN DRIVE DRAINAGE IMPROVEMENTS; APPROPRIATING $1,845; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be authorized to execute the documents necessary for the acquisition of a drainage easement in connection with the Main Drive Drainage Improvements, a substantial copy of which easement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $1,845 out of the Sixth Year Community Development Block Grant, Fund 162, Dept. 152, Activity 807.04, Code 502 for acquisition and appraisal services. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the purchase of land necessary for the abovementioned Main Drive Drainage Improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 12th day of October, 1983. Smith, of the County of Nueces, State of Texas, for and in considera- tion of the sum of One thousand Two hundred Dollars and no cents cents ( $1,200.00 ) to me in hand paid by the City of Corpus Christi, Nueces County, Texas, the receipt of which is hereby acknowledged, has granted and conveyed, and by these presents does grant and convey unto the City of Corpus Christi, Texas, a municipal corporation duly incor- porated under and by virtue of the laws of the State of Texas, its successors and legal representatives the free and unin- terrupted use, liberty, privilege, and easement of going in, on, over, under, and along a certain tract of land situated in Nueces County, Texas, and being described as follows: See: Page 2 Pae 1 of 5 Being a triangular shaped, 549 square feet, drainage easement out of the southwest corner of 5.037 acres of land described in Nueces County, Texas, Deed Records, Volume 1616, Pages 373 and 374, said 549 square feet drainage easement being more com- pletely described as follows: Beginning at a chisel mark in a concrete ditch at the southwest corner of said 5.037 acres which bears N. 85° 58' 28" E., ' 18.77 feet from a 1" iron rod witness corner, with said chisel mark being the southwest corner and point of beginning of this drainage easement; Thence N. 38° 11' 48" E„ 55.00 feet along the common boundary of said 5.037 acres and a 120 foot drainage easement des- cribed in County Deed Records, Volume 1093, Pages 184 and 185; Thence S. 11° 38' 30" W., 44.68 feet to the north line of Bearden Drive; Thence N. 88° 46' 10" W., 25 feet. along the north line of Bearden Drive to the point of beginning and containing about 549 square feet. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas for the purpose of construct- ing a public drainage facility, and for the purposes of main- taining, servicing, repairing, and inspecting said public drain- age facility under, on, and along said tract. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives, for the proper use as a drainage easement and drainage right-of-way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that event, the aforesaid rights and: privileges shall cease.
