AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.54, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS TRACTS 1, 2, 3, 4, AND 5, ALL OUT OF LOT
4, SECTION 11, BOHEMIAN COLONY LANDS; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of J. R. Ewing and E. H.
Moore for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Wednesday, October 12, 1983, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-1" on Tract 1,
"A-1" on Tract 2, "R -1C" on Tract 3, "R -1B" on Tract 4, and "R -1B" on Tract 5
all out of Lot 4, Section 11, Bohemian Colony Lands, Nueces County, Texas, more
fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.54 to hereafter read

as follows, such zoning classification of the hereinafter described properties
to be effective upon annexation:
"Section 31-5.54. The following described tracts of land shall be
zoned and classified as f011ows:
Tract 1
"B-1" Neighborhood Business District on the following more
particularly described tract:
FIELDNOTES for 2.88 acres of land, more or less, out of Lot
4, Section 11, Bohemian Colony Lands, a map of which is
recorded in Volume A, Page 48, Map Records of Nueces County,
Texas:
BEGINNING at the North corner of said Lot 4, Section 11 for
the North corner of this tract;
THENCE South 61°32'00" East, along the Northeast boundary
line of said Lot 4, 397.07 feet, more or less, to the East
corner of this tract;
THENCE South 28°28'00" West, leaving said North boundary
line, 315.00 feet, more or less, to the South corner of this
tract;
THENCE North 61°32'00" West 400.00 feet, more or less, to a
point on the center line of County Road No. 19 (Weber Road),
same being the Northwest boundary line of said Lot 4, for
the West corner of this easement;
THENCE North 29°00'00" East, along said Northwest boundary
line, 315.00 feet, more or less, to the POINT OF BEGINNING.
Tract 2
"A-1" Apartment House District on the following more particularly
described tract:
FIELDNOTES for 3.11 acres of land, more or less, out of Lot
4, Section 11, Bohemian Colony Lands, a map of which is
recorded in Volume A, Page 48, Map Records of Nueces County,
Texas:
BEGINNING at a point on the Northeast boundary line of said
Lot 4, Section 11, for the North corner of this tract from
which corner the North corner of said Lot 4 bears North
61°32'00" West 397.07 feet, more or less;

THENCE South 61°32'00" East, along said Northeast boundary
line 430.00 feet, more or less, to the East corner of this
tract;
THENCE South 28°28'00" West, leaving said Northeast boundary
line 315.00 feet, more or less, to the South corner of this
tract;
THENCE North 61°32'00" West 430.00 feet, more or less, to
the West corner of this tract;
THENCE North 28°28'00" East 315.00 feet, more or less, to
the POINT OF BEGINNING.
Tract 3
"R -1C" One -family Dwelling District on the following more particularly
described tract:
FIELDNOTES for 23.16 acres of land, more or less, out of Lot
4, Section 11, Bohemian Colony Lands, a map of which is
recorded in Volume A, Page 48, Map Records of Nueces County,
Texas:
BEGINNING at a point on the Northeast boundary line of said
Lot 4 for the North corner of this tract from which corner
the North corner of said Lot 4 bears North 61°32'00" West
827.07 feet, more or less;
THENCE South 61°32'00" East, with said Northeast boundary
line, 1278.64 feet, more or less, to a point on the
Northwest boundary line of a 160.00 foot wide City of Corpus
Christi drainage right-of-way for the East corner of this
tract;
THENCE South 61°39'00" West, with the Northwest boundary
line of said drainage right-of-way, 1496.66 feet, more or
less, to the point of curvature of a circular curve to the
right which has a central angle of 11°23'00", a radius of
207.94 feet, a tangent distance of 20.73 feet and an arc
length of 41.31 feet;

East 315.00 feet, more or less;

line, 830.00 feet, more or less, to the East corner of this
tract;
THENCE South 28°28'00" West 85.00 feet, more or less, to an
angle point of this tract;

"R -1B" One -family Dwelling District on the following more particularly
described tract:

4, Section 11, Bohemian Colony Lands, a map of which is
recorded in Volume A, Page 48, Map Records of Nueces County,
Texas:
BEGINNING at a point on the Southwest boundary line of said
Lot 4 for the West corner of this tract from which corner
the West corner of said Lot 4 bears North 61°32'00" West
800.00 feet, more or less;
THENCE North 28°28'00" East, leaving said Southwest boundary
line 380.00 feet, more or less, to the North corner of this
tract;
THENCE South 61°32'00" East 200.00 feet, more or less, to
the East corner of this tract;
THENCE South 28°28'00" West 380.00 feet, more or less, to a
point on the aforementioned Southwest boundary line for the
South corner of this tract;
THENCE North 61°32'00" West, with said Southwest boundary
line 200.00 feet, more or less, to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring

suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
