HomeMy WebLinkAbout17894 ORD - 10/19/1983AN ORDINANCE IMPOSING A GROSS RECEIPTS TAX ON THE CONDUCT OF BINGO GAMES WITHIN THE CITY; PROVIDING FOR PUBLICATION, AN EFFECTIVE DATE, AND NOTIFICATION TO THE COMPTROLLER OF PUBLIC ACCOUNTS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi, Texas, hereby imposes and levies a gross receipts tax on the conduct of bingo games within the city limits of the City of Corpus Christi, Texas, to be imposed, levied, assessed and collected in the manner provided by the Texas Bingo Enabling Act, Article 179d of Vernon's Annotated Texas Statutes. The amount of such tax imposed shall be equal to two percent (2%) of the gross receipts from the conduct of bingo games; provided that, in accordance with Section 3(d) of said Act, for so long as the commissioners court of Nueces County, Texas, imposes such a gross receipts tax, the tax imposed by the City hereunder shall be at the rate of one percent (1%) of the taxable gross receipts. SECTION 2. That notice of the passage of this ordinance be given by publication of the caption hereof stating in substance the purpose of the ordinance one time in the official publication of the City. The ordinance shall be and become effective on and after January 1, 1984, and the City Secretary shall forward to the Comptroller of Public Accounts of the State of Texas by certified or registered mail a certified copy of this ordinance accompanied by a map of the City clearly showing its boundaries. SECTION 3. If for any reason any section , paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 17994 OEILMED SEP 2d1984 That the foregoing ordinance second reading on this the following vote: Luther Jones Betty N.
