WARD BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF THE GREGORIO FARIAS GRANT, ABSTRACT NO. 592 FROM "A-1" APARTMENT HOUSE DISTRICT AND "B-1" NEIGHBORHOOD BUSINESS DISTRICT TO "A-2" APARTMENT HOUSE DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Aaron L. Ward for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 26, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tract of land described as a portion out of the Gregorio Farias Grant, Abstract No. 592, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "A-1" Apartment House District and "B-1" Neighborhood Business District to "A-2" Apartment House District: Being 18.157 acres, more or less, out of the Gregorio Farias Grant, Abstract No. 592, also being a portion of the J. A. Magee lands and being a portion of the Guy Braselton tract described in Deed of record in Vol. 578, Pages 145-147 of the Deed Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows: to -wit: BEGINNING at a point marked by a one -inch iron pipe set at the intersection of the West boundary line of Sharpsburg Road with the North boundary line of 17906 SEP281984 MICROFILMED Interstate Highway No. 37 for the SE corner of this tract and the point of beginning; THENCE S. 83°36'02" W, along the northerly boundary of said I.H. 37, a distance of 121.89 feet to a point marked by a concrete monument for a southerly corner of this tract; THENCE N. 76°18'03" W, along the northerly boundary of said I.H. No. 37, a distance of 927.21 feet to a point marked by a concrete monument set in the easterly r.o.w. line of the Missouri Pacific Railroad for the S.W. corner of this tract; THENCE in a northwesterly direction, along a curve to the left whose central angle is 12°09'30" and whose radius is 3078.73 feet, and along the easterly r.o.w. line of said Missouri Pacific Railroad, a distance of 651.52 feet to a point marked by a one -inch iron pipe for the N.W. corner of this tract; THENCE N. 66°56'08" E, along the southerly line of the Ernest Barkley 1.17 acre tract described in deed recorded in Vol. 556, Page 426 of the Deed Records of Nueces County, Texas, a distance of 762.04 feet to a point marked by a 3/4" iron pipe set in the westerly r.o.w. line of said Sharpsburg Road, for the N.E. corner of this tract; THENCE S 21°48'57" E. along the westerly r.o.w. line of said Sharpsburg Road, a distance of 1228.56 feet to the POINT OF BEGINNING, and containing 18.157 acres of land, more or less. SAVE AND EXCEPT THE FOLLOWING: Being a tract of land situated in Corpus Christi, Nueces County, Texas, containing 3.18 acres, more or less, out of the Gregorio Farias Grant, Abstract No. 592, also being a portion of the I. A. Magee Lands, and being a portion of an 18.157 acre tract described in Deed recorded in Volume 1612, Page 179, of the Deed Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows, to -wit: Beginning at a point marked by a 3/4 inch iron pipe set at the NE corner of said 18.157 acre tract, in the westerly boundary line of Sharpsburg Road, also being the SE corner of the Ernest Barkley tract described in deed recorded in Volume 556, Page 126, of the Deed Records of Nueces County, Texas, the point of beginnin THENCE S 21°48'57" E, said Sharpsburg Road 18.157 acre tract, a marked by a 5/8 inch tract; for the NE corner of this tract and g. along the westerly boundary line of and along the easterly line of said distance of 360.43 feet to a point iron rod for the SE corner of this THENCE N 87°49'31" W, a distance of 579.93 feet to a point marked by a 5/8 inch iron rod for a southerly corner of this tract; THENCE N 86°50'54" W a distance of 256.02 feet to a point marked by a 1 -inch iron pipe for the most westerly corner of this tract, also being the NW corner of said 18.157 acre tract; THENCE N 66°56'08" E, along the southerly line of said Ernest Barkley tract, a distance of 762.04 feet to the point of beginning, and containing 3.18 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed ndi shall tak ffgct upon first reading as an emergency measure this the �— day of � lc� , 19)43 . / ATTEST: y ecretary MAYOR P (,QR DAY OF J.
