HomeMy WebLinkAbout17923 ORD - 11/02/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CORPUS CHRISTI THEATRES, INC. BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOTS 1 AND 2, BLOCK 1, NUECES RIVER IRRIGATION PARK FROM "F -R" FARM -RURAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Corpus Christi Theatres, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, November 2, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tract of land described as a portion out of Lots 1 and 2, Block 1, Nueces River Irrigation Park, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "F -R" Farm -Rural District to "B-4" General Business District: BEING 7.00 acres of land, more or less, out of a 39.233 acre tract described in Volume 1732, Page 646, Deed Records of Nueces County, Texas, and being a portion of Lot 1 and Lot 2, Block 1 of the Nueces River Irrigation Park recorded in Volume A, Page 54, Map Records of Nueces County, Texas, and said 7.00 acres being more particularly described by metes and bounds as follows: BEGINNING at the northeast corner of this tract, said corner lying on the south right-of-way line of F.M. Road No. 624 and said corner bearing S 84°09'E, 357.31 feet along said R.O.W. Line from the northeast corner of a 1.556 acre tract described in Volume 228, Page 1331, Deed Records of Nueces County, Texas; SEP 2 8 1984 17923 MICROFILMED THENCE S 10°00'W, along the east boundary of this tract, 640.00 feet, to the southeast corner of this tract; THENCE N 84°09'W, 583.90 feet, to the southwest corner of this tract, said corner being on the east boundary line of Riverside Hospital tract and the west boundary line of said 39.233 acre tract and bearing N 10°00' E, 874.85 feet, from the southwest corner of said 39.233 acre tract; THENCE N 10°00' E along the west boundary line of this tract, the same being the boundary line between said Riverside Hospital tract and said 39.233 acre tract, 340.00 feet, to a corner of this tract, said corner also being the southwest corner of said 1.556 acre tract; THENCE S 84°09' E along the south boundary of said 1.556 acre tract, 226.59 feet, to an inside corner of this 7.00 acre tract, the same being the southeast corner of said 1.556 acre tract; THENCE N 10°00' E along the east boundary of said 1.556 acre tract, 300.00 feet, to a corner of this tract, the same being the northeast corner of said 1.556 acre tract, said corner lying on the south right-of-way line of F.M. Road No. 624; THENCE S 84°09' E along said south R.O.W. line, 357.31 feet, to the point of beginning and containing 7.00 acres of land, more or less. This description has been prepared from deeds of record and not by actual surveys made on the ground. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall to effect up+ day of All __ ATTEST: n firstlading as an emergency measure this the p?/)(r , 191 Cit Secretary MAYOR AP ROV D: DAY OF 1/% , 19 3 : J.
