HomeMy WebLinkAbout17928 ORD - 11/09/1983AN ORDINANCE CLOSING AND ABANDONING THE EAST -WEST 10 FOOT WIDE UTILITY EASEMENT IN LOT 1, BLOCK 1, MORGAN SCHOOL TRACT; SUBJECT TO PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists the east -west 10 foot wide utility easement in Lot 1, Block 1, Morgan School Tract, shown by plat in Volume 48, Pages 42 - 43, Map Records, Nueces County, Texas, from the west end of said Lot 1 to the west line of 10 foot wide drainage easement; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned the east -west 10 foot wide utility easement in Lot 1, Block 1, Morgan School Tract, shown by plat in Volume 48, Pages 42 - 43, Map Records, Nueces County, Texas, from the west end of said Lot 1 to the west line of 10 foot wide drainage easement, providing that said Lot 1 be replatted at the owner's expense. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid utility easement, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 9th day of November, 1983.
