AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.57, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS TRACTS 1, 2, 4, 5, AND 6, ALL OUT OF LOTS
4, 5, 6, 9, 10, 11, AND 12, SECTION 20, FLOUR BLUFF AND
ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Topel Business, Inc.,
et al for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Wednesday, November 2, 1983, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" on Tract 1,
"A-2" on Tract 2, "R-2" on Tracts 4 and 5, and "R -1B" on Tract 6 all out of Lots
4, 5, 6, 9, 10, 11, and 12, Section 20, Flour Bluff and Encinal Farm and Garden
Tracts, Nueces County, Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.

SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.57 to hereafter read
as follows, such zoning classification of the hereinafter described properties
to be effective upon annexation:
"Section 31-5.57. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"B-4" General Business District on the following more particularly
described tract:
Description of a 14.620 acre tract of land out of Lots 4 and
5, Section 20, Flour Bluff and Encinal Farm and Garden
Tracts, as recorded at Vol. A, Pgs. 41-43, Map Records of
Nueces County, Texas.
BEGINNING at a point, the intersection of Airline Road and
Saratoga Boulevard;
THENCE, with the centerline of Saratoga Boulevard, S
60°55'30" E, 1313.20 feet to a point for corner;
THENCE, S 29°04'30" W, at 60.00 feet pass the southwesterly
right-of-way of Saratoga Boulevard, in all a distance of
480.00 feet to a point for corner;
THENCE, N 60°55'30" W, 506.90 feet to a point for corner;
THENCE, N 87°30'00" W, at 476.37 feet pass the easterly
right-of-way line of Airline Road, in all a distance of
506.37 feet to a point in the centerline of Airline Road for
corner;
THENCE, with the centerline of Airline Road N 2°30'00" E,
790.00 feet to the point of beginning, said tract containing
14.620 acres of land, more or less.
Tract 2
"A-2" Apartment House District on the following more particularly
described tract:
Description of a 13.093 acre tract of land out of Lots 5 and
6, Section 20, Flour Bluff and Encinal Farm and Garden
Tracts, as recorded at Vol. A, Pages 41-43, Map Records of
Nueces County, Texas.
BEGINNING at a point from whence the intersection of the
centerlines of Saratoga Boulevard and Airline Road bears N
60°55'30" W, 1,313.20 feet;
THENCE, with the centerline of Saratoga Boulevard, S
60°55'30" E, 668.93 feet to a point for corner;
THENCE, S 29°04'30" W, at 60.00 feet pass a 5/8 inch iron
rod in the southwesterly right-of-way of Saratoga Boulevard,
in all a distance of 852.63 feet to a point for corner;
THENCE, N 60°55'30" W, 668.93 feet to a point for corner;
THENCE, N 29°04'30" E, at 792.63 feet pass the southwesterly
right-of-way line of Saratoga Boulevard, in all a distance
of 852.63 feet to the point of beginning, said tract
containing 13.093 acres of land, more or less.
Tract 4
"R-2" Multiple Dwelling District on the following more particularly
described tract:
Description of an 8.856 acre tract of land out of Lots 5 and
6, Section 20, Flour Bluff and Encinal Farm and Garden
Tracts, as recorded at Vol. A, Pages 41-43, Map Records of
Nueces County, Texas.
BEGINNING at a point from whence the intersection of the
centerlines of Saratoga Boulevard and Airline Road bears N
29°04'30" E, 852.63 feet and N 60°55'30" W, 963.20 feet;
THENCE, S 60°55'30" E, 1,018.93 feet to a point for corner;
THENCE, S 29°04'30" W, 422.37 feet to a point for corner;
THENCE, N 60°55'30" W, 807.65 feet to a point for corner;
THENCE, N 2°30'00" E, 472.27 feet to the point of beginning,
said tract containing 8.856 acres of land, more or less.

"R-2" Multiple Dwelling District on the following more particularly

THENCE S 60°55'30" E, 689.34 feet to a 5/8 inch iron rod for

THENCE, S 29°04'30" W, 158.40 feet to a 5/8 inch iron rod
for corner;
THENCE S 60°55'30" E, at 185.00 feet pass a 5/8 inch iron
rod in the northwesterly right-of-way line of Rodd Field
Road, in all a distance of 245.00 feet to a point in the

Records of Nueces County, Texas.
BEGINNING at a point in the centerline of Airline Road from
whence the intersection of the centerlines of Airline Road
and Saratoga Boulevard bears N 2°30'00" E, 1,480.24;
THENCE, S 74°14'55" E, at 30.82 feet pass the easterly
right-of-way line of Airline Road, in all a distance of
211.97 feet to a point for corner;
THENCE, S 60°55'30" E, 1113.65 feet to a point for corner;
THENCE, S 29°04'30" W, 45.00 feet to a 5/8 inch iron rod for
corner;
THENCE, S 60°55'30" E, 385.00 inches to a point for corner;

THENCE, with the centerline of Airline Road, N 2°30'00" E,
1002.19 feet to the point of beginning, said tract
containing 40.932 acres of land, more or less.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is pas ed and
shall take effect upon first reading as an emergency measure this the %d,(> day

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
