AN ORDINANCE
AUTHORIZING THE EXECUTION OF A CONTRACT WITH GOLDSTON
; ENGINEERING, INC. FOR PREPARATION OF PRELIMINARY ENGINEERING
STUDIES FOR FUTURE IMPROVEMENTS TO AGNES STREET FROM PORT
AVENUE TO OLD ROBSTOWN ROAD AND TO WALDRON ROAD FROM SOUTH
PADRE ISLAND DRIVE TO PURDUE ROAD; APPROPRIATING $23,150;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is hereby authorized to execute a
contract with Goldston Engineering, Inc. for preparation of preliminary
engineering studies for future improvements to Agnes Street from Port Avenue to
Old Robstown Road and to Waldron Road from South Padre Island Drive to Purdue
Road, all as more fully set forth in the contract, a substantial copy of which
is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated $23,150 from the
No. 162-152-807.07-502, Ninth Year Community Development Block Grant Fund which
includes preliminary planning, preliminary testing and the design phase
applicable to project No. 162-152-807.07-502, Agnes Street and Waldron Road
Preliminary Engineering Studies.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
immediate action to preserve and protect public property by expediting the
construction of public improvements, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings so that this ordinance
is passed and shall take effect upon first reading as an emergency measure this
the 16th day of November, 1983.

The City of Corpus Christi, hereinafter called "City" and Goldston Engineering,
Inc., hereinafter called "Engineer" agree as follows:
I. SERVICES TO BE PERFORMED
The Engineer hereby agrees at his own expense to perform all necessary
work to prepare preliminary engineering design study reports for the future improve-
ments to Agnes Street from Port Avenue to Old Robstown Road and to Waldron Road
from South Padre Island Drive to Purdue Road. A separate engineering report for
each street shall be prepared and shall include but not be limited to:
A. Analysis of future required street widths utilizing;
(1) Traffic projections,
(2) Current zoning and/or land use plans of the adjacent areas,
and
(3) Existing Urban Transportation Plan.
B. Recommendation of a pavement section design utilizing;
(1) Traffic projections, including Directional Distribution and
Composition (truck count to include number of axles), and
(2) Geotechnical evaluations of existing soil conditions.
C. Analysis of storm drainage requirements;
(1) Along Agnes Street, a study of the existing system in the
area will be necessary to determine appropriate locations for extending the system.
Engineer is to recommend route, size and estimated cost of such drainage system.
(2) For Waldron Road, a review of the Storm Drainage Master Plan
for adequacy and a determination of the drainage facilities required, both on and
offsite, to include recommended outfall routes, rights of way costs, private pipe-
line adjustment or effect on other City Master Plans. Comment on any needed Master
Plan revisions. City will provide access to records of existing systems and copies
of Master Plans.
D. Impact of proposed improvements on adjacent properties including
right-of-way requirements for both the street and storm drainage facilities.

Appraisal work for this purpose is not included in the scope of this study, i.e.
reasonable estimates for this purpose are adequate. In particular, the impact of
improvements along Agnes Street upon businesses with head -in parking which might be
eliminated. City will provide access to its records of traffic counts, right-of-
way and subdivisional plats.
L. With ..be assistance of the City's Traffic Engineering staff, comment
on any traffic control required including signalization at intersecting streets.
F. Review of existing and proposed utilities within the project limits
and relocation/adjustment requirements. Comment on any facilities proposed by
Master Water and Sanitary Sewer Plans.
G. Other factors having an impact on the proposed improvement such as
the impact of the adjacent railroad tracks to Agnes Street.
H. Preliminary cost estimates for the various components of the pro-
ject.
II. ORDERLY RENDERING OF SERVICES
The Engineer shall furnish five draft copies of the reports for review
and comment by the City within 75 calendar days of the effective date of this
agreement. Ten copies of the final report shall be submitted within 20 calendar
days of return of the draft reports.
III. TRANSFER OF INTEREST
The Engineer shall not assign or transfer any interest in this contract
without prior written consent from the City.
IV. COMPLIANCE WITH FEDERAL REQUIREMENTS
These reports are being funded by the Community Development Act of 1974,
9th Year Program. As a result, the Engineer is required to familiarize himself and
comply with the requirements of the regulations associated with this program.
V. COMPENSATION
The City agrees to pay the Engineer for services rendered a fee not to
exceed Twenty-three Thousand One Hundred Fifty Dollars ($23,150.00). Billing for
this work by the Engineer will be based on the hourly rates specified in the
schedule identified as Exhibit "A" attached hereto and made a part hereof. Addi-
tionally, the geotechnical testing necessary for these reports is estimated at
$2,670 and shall be included in the fee. Two payments shall be made to the Engineer;
one upon submission of the draft reports and one upon completion and acceptance of
the final report based upon invoices submitted by the Engineer.

VI. CONTRACT TERMINATION
The City reserves the right to terminate this contract at any time, with
or without cause. In the event of such termination, the Engineer will be paid a sum
proportionate to the state of completion of the work.
VII. DISCLOSURE STATEMENT
The Engineer agrees, in compliance with City Ordinancc No. 17113, to
complete the Disclosure of Interests form attached hereto and made a part hereof.

COMPUTER
Charges by computer services companies for use of proprietary programs and processing
time is passed through to the client without any markup.
Charges for our machine time used is at the rate of $50.00 per hour based upon conned
time to the computer service.
Keypunch operator time is charged at the rate of $15.00 per hour.
For use of our machine and our in-house developed programs, charges are made at the
rate of $75.00 per hour for the time the machine is used.

DEFINITIONS
