HomeMy WebLinkAbout17962 ORD - 12/07/1983TEXAS: AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT WITH URBAN ENGINEERING FOR ENGINEERING SERVICES ON THE STEP 3 CONSTRUCTION AT THE ALLISON WASTEWATER TREATMENT PLANT WHICH INCORPORATES VARIOUS CHANGES TO THE ORIGINAL CONTRACT WHICH ARE REQUESTED BY THE ENVIRONMENTAL PROTECTION AGENCY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be authorized to execute an amendment to the contract with Urban Engineering for engineering services on the Step 3 construction at the Allison Wastewater Treatment Plant which incorporates various changes to the original contract which were requested by the Environmental Protection Agency, a substantial copy of which amendment is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 7th day of December, 1983. Bruce Aycoc City Attorney THE CITY OF CORPUS CHRISTI, TEXAS 1.7962 SEP 28 1984 MICROFILMED adl1 uriuJWED ENGINEERING CONTRACT ALLISON WASTEWATER TREATMENT PLANT STEP 3 CONSTRUCTION AMENDMENT NO. 1 THE STATE OF TEXAS X COUNTY OF NUECES X - The City of Corpus Christi and Urban Engineering agree to the following amendment to the contract for Engineering Services regarding construction of the Allison Wastewater Treatment Plant, Step 3 work, which was authorized by the City of Corpus Christi on November 2, 1983 by the passage of Ordinance No. 17911, by changing the following terms and conditions: SECTION D - COMPENSATION 1. The fee structure shall be amended as follows: COST FIXED FEE TOTAL Contract Administration $ 72,000 $11,500 $ 83,500 Final Plan of Operation 860 140 1,000 The following fees shall remain as specified in the original engineering contract: Resident Inspection 0&M Manual Project Performance 108,217 8,043 28,388 16,313 1,207 4,259 124,530 9,250 32,647 $217,508 $33,419 $250,927 Payment for Step 3 engineering shall not exceed $250,927 without written approval from the City of Corpus Christi. 2. Payments a. The portion of the fee designated as "Cost" will be billed on an actual cost basis as engineering costs are incurred. The portion of the fee designated as "Fixed Fee" may be billed on the actual percentage of completion of the construction contract. SECTION H - TIME OF COMPLETION The time for completion of the Engineer's services is based on a period beginning four (4) months prior to the start of construction and shall include the construction period of four hundred fifty (450) working days and shall extend for a period of one (1) year following completion of con- struction. The one year period following completion of the plant is desig- nated as "Project Performance" and shall be limited to those duties specifically outlined in this contract as pertaining to "Project Performance". , ii. '4" The provisions of this amendment specifically replace those provisions of the engineering contract referred to herein with all other terms and conditions remaining in full force and effect.
