HomeMy WebLinkAbout17969 ORD - 12/07/1983AN ORDINANCE AMENDING ARTICLE V OF THE CITY CODE BY ADDING SECTION 33-97 TO PROVIDE FOR ANNUAL PERMITS FOR PERMANENT OUTDOOR CONCERT FACILITIES OPERATING AS AN ONGOING BUSINESS AND ESTABLISHING A FEE FOR SAID ANNUAL PERMITS; AND PROVIDING FOR PUBLICATION AND SEVERABILITY.' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Article V, Outdoor Music Festivals, of the Code of Ordinances of the City of Corpus Christi, Texas,„as amended, be amended by adding Section 33-97 to hereinafter read as follows: Sec. 33-97. Permanent facilities; annual permits; fee; inspections (a) Permanent outdoor concert facilities operated as an ongoing business shall be exempt from the requirement of applying for a permit for each event but shall, upon application and compliance with all other applicable provisions of this article, receive an annual permit to hold outdoor music festivals at a specified location in accordance with the provisions of the application. City owned permanent outdoor concert facilities such as the Cole • Park Amphitheatre, and regular events such as Bayfest operated under the terms of a lease agreement with the City, are also exempt from this ordinance. (b) Such annual permit shall be valid for a period of one' year from its date of issue and shall be renewable from year to year upon application and payment of the required fee as herein provided for single -event outdoor music festivals, provided, however, that the fee for an annual permit shall be $25.00. (c) Such permanent outdoor facilities shall be subject to inspection at all reasonable times and permits granted therfor shall be revocable by the City Council upon a finding that the facilities no longer comply with the provisions expressed in the application. SECTION 2. This ordinance shall take effect from and after its publication one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance. 1'7969 ,, f SEP 2 81984 MICROFILMED SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
