CLOSING AND ABANDONING THE 40 FOOT WIDE RIGHT-OF-WAY IN LOTS
9, 10, 11, 22, 23, AND 24, SECTION 11, FLOUR BLUFF AND
ENCINAL FARM AND GARDEN TRACTS; SUBJECT TO PROVISIONS LISTED
BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of the right-of-way in Lots 9, 10, 11, 22, 23, and 24, Section 11,
Flour Bluff and Encinal Farm and Garden Tracts, as recorded in Volume A, Pages
41-43, Map Records, Nueces County, Texas, was given by publication and mailed to
the last known addresses of the owners of property abutting the public way and
within 450 feet of the area proposed to be closed, and thereafter, pursuant to
said notice, public hearing was held at Regular Council Meeting by the City
Council of the City of Corpus Christi on December 7, 4983, in accordance with
the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will it be within the foreseeable future needed as public right of way, and
that the same should revert to the abutting property owners, subject to certain
specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned the 40 foot wide
right-of-way in Lots 9, 10, 11, 22, 23, and 24, Section 11, Flour Bluff and
Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 42-43, Map
Records, Nueces County, Texas, and more fully described by metes and bounds and
a map, which is attached hereto and made a part hereof, marked Exhibit "A",
provided that the abovementioned lots are replated at the owners' expense.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid right-of-way, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this the
7th day of December, 1983.

Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in
Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas; save and except
the Southeast 40.00 feet of said Southwest 20.00 feet of Lot 9 and save and except
the Southeast 40.00 feet of said Northeast 20.00 feet of Lot 24;
BEGINNING at a point on the Northeast right-of-way line of a 40.00 foot
wide dedicated right-of-way known as County Road No. 26-A for the East corner
of this oarceI abandonment from which corner the centerline intersection of
said County Road No. 26-A and County Road No. 13 (Cimarron Road) bears South
61°00'00" East 40.00 feet to a point on the centerline of County Road No. 13
and with said centerline, South 28°57'30" West 20.00 feet and from said point
of beginning the centerline intersection of said County Road No. 13 (Cimarron
Road) and Brockhampton Street bears South 61°00'00" East 40.00 feet to a point
on the centerline of County Road No. 13 and with said centerline North 28°57'30"
East 230.00 feet;
THENCE leaving said existing Northeast right-of-way line of County Road
No. 26-A, South 28°57'30" West, at 20.00 feet pass the centerline of said
40.00 foot wide County Road No. 26-A, same being the common boundary line of
Lot 9 and Lot 24, Section 11, in all a distance of 40.00 feet to a point on
the existing Southwest right-of-way line of County Road No. 26-A for the South
corner of this tract;
THENCE North 61°00'00" West, along the Southwest line of said 40.00 foot
wide County Road No. 26-A, crossing through Lots 24, 23 and 22, 1944.05 feet
to a point on the common boundary line of Lot 21 and Lot 22, Section 11 for
the West corner of this tract;
THENCE leaving the Southwest line of County Road No. 26-A, North 28°55'05'
East, along the common boundary line of Lot 21 and Lot 22, at 20.00 feet pass
the centerline of said road for the common corner of Lots 11, 12, 21, 22 and
continuing North 28°55'05" East, along the common boundary line of Lot 11 and
Lot 12, in all a distance of 40.00 feet to a point on the aforementioned North-
east line of said County Road No. 26-A for the North corner of this tract;

line of said County Road, crossing through Lots 11, 10 and a portion of 9,
