HomeMy WebLinkAbout17977 ORD - 12/14/1983AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH GOLDSTON ENGINEERING, INC. FOR ENGINEERING SERVICES NECESSARY TO PROPERLY DEVELOP DESIGN PLANS AND SPECIFICATIONS FOR UPGRADING THE STORM WATER PUMP STATION "A"; APPROPRIATING $31,900; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a contract with Goldston Engineering, Inc. for engineering services necessary to properly develop design plans and specifications for upgrading the Storm Water Pump Station "A", located at 1218 North Water Street, a copy of which contract is attached hereto and made a part hereof marked Exhibit A. SECTION 2. That there is hereby appropriated $31,900 from the No. 295 Storm Sewer Bond Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 14th day of December, 1983. Bruce'Ayccock//City Attorney MAYOR 17977 THE CI Y OF CORPUS CHRISTI, TEXAS 'SEP 2 81984 MICROFIt_ Ain-) CONTRACT PROFESSIONAL ENGINEERING SERVICES THE STATE OF TEXAS § COUNTY OF NUECES § The City of Corpus Christi, Texas, hereinafter called "City", and Goldston Engineering, Inc., hereinafter called "Engineer", agree as follows: I. SERVICES TO BE PERFORMED The Engineer hereby agrees, at his own expense, to perform all architectural, structural, mechanical, electrical, site work design, and related services necessary to properly develop design plans and specifications for upgrading the Storm Water Pump Station "A", located at 1218 North Water Street, to include: A. Phase I: 1. Replacement of one existing engine with a new diesel engine equipped with automatic start controls and electric start batteries, automatic battery charger and a telemetry (3 point) system. 2. Installation of a trash screen at the pump inlet connected to existing standby power. 3. Oversee the teardown and inspection of the #2 engine removed from the station. Inspect underfloor piping of the #2 engine. 4. Prepare a report on the condition of the removed engine and underfloor piping with recommendations as to repair and/or replacement of the remaining two engines. B. Phase II: To be performed if authorized, (based on Phase I, Item 4 report). 1. Oversee repair of the two remaining engines. 2. Inspect and oversee the repair of the underfloor water and oil piping. system. 3. Equip the repaired engines with a water temperature control 4. Install an automatic compressed air system to provide supply and relief to maintain constant pressure in the three air tanks. II. SCOPE OF SERVICES The Engineer agrees to perform, for the above named work, professional services as hereinafter set forth: A. Construction Documents Phase 1. Prepare complete working drawings and technical Engineering Services - Goldston Engineering Storm Water Pump Station "A" Page 1 of 5 specifications setting forth in detail the requirements for furnishing, installing and repairing the facilities outlined in Article I.A. Phase I. The Engineer will confer with the City staff during this phase to coordinate the design of the project and incorporate all desired features. 2. Submit a cost estimate. 3. Submit to the City Engineer three (3) complete sets of the documents as outlined in Phase I, Items 1, 2 and 3 for review by the City. 4. If authorized, prepare bid documents for Phase II, Items 1 through 4. B. Bidding and Contract Phase 1. Upon approval of the construction documents by the City, provide the City with reproducible copies of the documents required in Phase I, Items 1, 2 and 3. 2. Provide lists of prospective qualified bidders in the area to the City for Phase I, Items 1, 2 and 3. 3. Provide a list of prospective qualified bidders in the area for Phase II, Items 1 through 4, if authorized. 4. Submit a written recommendation of the award of the contract to the City. In the event the lowest acceptable bid exceeds the estimated cost, the Engineer shall confer with the City and make such revisions as is satisfactory to the City for the readvertising of bids, without increases in the Basic Fee. C. Construction Phase 1. Be the City's representative during the construction period which begins with the award of the contract or contracts and extends until the final acceptance of the project. 2. In relation to Phase I, Items 1 and 2 of Article I.A., provide the general administration of construction including periodic visits to the site to familiarize himself generally with the progress and quality of work and to determine in general if the work is proceeding in accordance with the contract. The Engineer will endeavor to guard the City against defects and deficiencies in the work of contractors, but he does not guarantee the performance of their contracts. Inspections will certify that work has progressed to the point indicated and is in accordance with the construction contract and that the contractor is entitled to payment. 3. Have the authority to stop work whenever such stoppage may be Engineering Services - Goldston Engineering Storm Water Pump Station "A" Page 2 of 5 necessary in his reasonable opinion to insure the proper execution of the contract and may condemn work as failing to conform to the contract. 4. In relation to Phase I, Items 3 and 4 and Phase II, Items 1 and 2, the Engineer will be required to examine and measure the components of the engines and piping system and make a determination as to replacement or repairs needed. Prepare the necessary drawings and specifications for water temperature control and compressed air controls as per Phase II, Items 3 and 4. Should the cost of repairs exceed the cost of a new engine, prepare the necessary change orders to install new engine(s). D. As -Built Drawings and Maintenance Manuals 1. The Engineer shall furnish to the City, upon completion of said project, or upon termination of the contract as herein provided, a suitable bound copy of the specifications and a reproducible set on mylar, or tracing of the working drawings, including any and all corrections, revisions, alterations, or amendments to the plans and/or specifications made during the Construction Phase so as to reflect the true plans and specifications of the building as built. 2. The Engineer shall use 24"x36" sheet sizes of 3 mil mylar or tracing for the "as -built" drawings which are to be submitted as described above. 3. The Engineer shall furnish to the City, upon project completion, operating manuals or instructions, parts lists, or maintenance manuals for all mechanical, electrical, or any other equipment installed on the project. 4. The City will not make final payment to the Engineer until the conditions of Article II.D. are met. E. Transfer of Interest The Engineer shall not assign or transfer any interest in this contract without prior written consent from the City. F. Orderly Rendering of Services The Engineer shall furnish the documents required in each phase of the design and personally render or provide the service required in this contract in the sequence and times herein indicated and as may be necessary to insure the prompt and continuous prosecution of the work of designing and constructing the project, and it is understood that all designs and details of designing are subject to the approval of the City, and until the acceptance of Engineering Services - Goldston Engineering Storm Water Pump Station "A" Page 3 of 5 results of these services, there shall be no liability on the part of the City for such services. Engineer agrees to furnish: 1. The construction documents with Phase I, Items 1, 2 and 3 within 150 calendar days of effective date of this contract. 2. The condition report of Phase I, Item 4 within 30 calendar days of the completion of the engine teardown. 3. The construction documents for Phase II within 120 calendar days of acceptance of the condition report, Phase I, Item 4, and City's authorization to begin Phase II. G. Cost Estimates The Engineer is to provide an estimate of costs at the time of submission of the Construction Documents Phase, but does not guarantee the accuracy of such estimates. Total funds available for the project, including engineering is $235,000. The Engineer will attempt to provide a design with a construction cost within the acceptable cost to the City. The City will have the right to require the Engineer to make revisions to the construction documents so as to bring the cost within funds available at no additional fee. III. COMPENSATION A. Fee Schedule and Payments to the Engineer The City agrees to pay the Engineer for his services a fee not to exceed Thirty-one Thousand, Nine Hundred and no/100 Dollars ($31,900.00) based upon the following: Construction (1) Bidding & Contract(1) Construction Total Fee Document Phase Award Phase Phase Phase I Items 1 & 2 $17,400 $14,900. $800 $1,700 Phase I $ 4,500(3) Items 3 & 4 Maximum Phase II $ 8,000(3) Items 1 & 2 Maximum Phase II Items 3 & 4 $2,000 $ 1,500 $250 $ 250(2) (1) Payment of the sums indicated above will be made upon completion of that particular phase and acceptance of same by the City or at the option of the City on a monthly basis with a 15% retainage. (2) Payment of the sum indicated may be made in monthly installments as the percentage of the construction contractor's monthly estimate for these items relates to the total construction contract amount for these items. (3) This amount is not to exceed figure with payments to be based upon the actual hours worked and the hourly rates specified in the schedule identi- fied as Exhibit "A" attached hereto and made a part hereof. Monthly payments will be made upon submission of invoices by the Engineer. Engineering Services - Goldston Engineering Storm Water Pump Station "A" Page 4 of 5 B. Change in Contract Scope Should it be determined during the Construction Phase that the cost of Items 1 through 4 of Article I.B. will exceed the cost of installing new engine(s), then the City shall pay the Engineer the sum of Six Thousand Five Hundred and no/100 Dollars ($6,500.00) for the second new engine installed, and the fees for Phase II, Items 1 and 2 and Phase II, Items 3 and 4 shall be reduced by Four Thousand Five Hundred and no/100 Dollars ($4,500.00) and Five Hundred and no/100 Dollars ($500.00), respectively. For the third new engine installed, the City shall pay the Engineer the sum of Three Thousand Five Hundred and no/100 Dollars ($3,500.00) and the fees for Phase II, Items 1 and 2 and Phase II, Items 3 and 4 shall be reduced by Three Thousand Five Hundred and no/100 Dollars ($3,500.00) and One Thousand Five Hundred and no/100 Dollars ($1,500.00), respectively. In the event no repairs to the remaining engines are recommended in the report (Phase I, Item 4) or authorized by the City, the fee for Phase II, Items 1 and 2 shall be eliminated. IV. CONTRACT TERMINATION The City reserves the right to terminate this contract at any time, with or without cause. In the event of such termination, the Engineer will be paid a sum proportionate to the state of completion of the work. V. DISCLOSURE STATEMENT The Engineer agrees, in compliance with City Ordinance No. 17112, to complete the Disclosure of Interests form attached hereto and made a part hereof.
