HomeMy WebLinkAbout17980 ORD - 12/14/1983AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.58, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS TRACTS 1 AND 2 OUT OF TRACT 4, McINTYRE PARTITION OUT OF THE MARIANO LOPEZ DE HERRERA GRANT, ABSTRACT NO. 606; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of 1889 Group for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, December 7, 1983, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "6-4" on Tracts 1 and 2 out of Tract 4, McIntyre Partition out of the Mariano Lopez de Herrera Grant, Abstract No. 606, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.58 to hereafter read SEP 2 81984 MICROFILMED 17980 as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: "Section 31-5.58. The following described tracts of land shall be zoned and classified as follows: Tract 1 "8-4" General Business District on the following more particularly described tract: DESCRIPTION of a portion of Tract 4, McIntyre Partition out of the Mariano Lopez de Herrera Grant, Abstract No. 606, as described in deed recorded in County Clerk's File No. 17762, on November 20, 1924, in the Deed Records, Nueces County, Texas, and being described as follows: BEGINNING at the intersection of the centerline of Farm -to -Market Road No. 624 and the westerly city limits line of the City of Corpus Christi, Texas; THENCE, S 0°14'59" W, along said city limits line, 356.07 feet to the southeast corner of this tract; THENCE, N 84°04'34" W, 1,512.58 feet to the southwest corner of this tract; THENCE, N 9°29'49" E, 351.99 feet to the proposed centerline of said Farm -to -Market Road 624 and the northwest corner of this tract; THENCE, S 84°04'34" E, along the proposed centerline of Farm -to -Market Road 624, 1,302.43 feet to the beginning of a curve to the left; THENCE, in an easterly direction, continuing along said centerline and the arc of said curve to the left, having a radius of 5,729.58 feet, a central angle of 1°31'52", a distance of 153.12 feet to the POINT OF BEGINNING. CONTAINING 11.97 acres, more or less. Tract 2 "B-4" General Business District on the following more particularly described tract: DESCRIPTION of a portion of Tract 4, McIntyre Partition out of the Mariano Lopez de Herrera Grant, Abstract No. 606, as described in deed recorded in County Clerk's File No. 17762, on November 20, 1924, in the Deed Records, Nueces County, Texas, and being described as follows: BEGINNING at the intersection Farm -to -Market Road No. 1889, with line of the City of Corpus Christi, THENCE, S 9°58'02" W, along t Farm -to -Market Road 1889, 265.62 corner of this tract; of the centerline of the southern city limits Texas: he centerline of said feet to a point, for a THENCE, N 84°04'34" W, 811.05 feet to the southwest corner of this tract; THENCE, N 5°55'26" E, 264.96 feet to the northwest corner of this tract; THENCE, S 84°04'34" E, 829.78 feet to the POINT OF BEGINNING. CONTAINING 4.99 acres, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
