AN ORDINANCE
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF DAVID M.
SAKS, TRUSTEE, BY CHANGING THE ZONING MAP IN REFERENCE TO
LOT 1, BLOCK 9, LEXINGTON CENTER ADDITION AND A PORTION OUT
OF LOT 3, SECTION 4, BOHEMIAN COLONY LANDS, FROM "R -1B"
ONE -FAMILY DWELLING DISTRICT TO "B-4" GENERAL BUSINESS
DISTRICT; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of David M. Saks,
Trustee, for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Coun9il
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Wednesday, December 14, 1983, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
'. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That the zoning on Lot 1, Block 9, Lexington Center
Addition and a portion out of Lot 3, Section 4, Bohemian Colony Lands, as
described by metes and bounds below, situated in the City of Corpus Christi,
Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to
"B-4" General Business District. r
FIELDNOTES for 33.28 acres of land comprising a portion of
Lot 1, Block 9, Lexington Center, a map of which is recorded
in Volume 36, Pages 142, Map Records of Nueces County,
Texas, and a portion of Lot 3, Section 4, Bohemian Colony
Lands, a map of which is recorded in Volume A, Page 48, Map
Records of Nueces County, Texas:
BEGINNING at a 5/8 inch iron rod found at the West corner of
said Lot 1, Block 9, for the West corner of this survey;
THENCE North 29°03'20" East, along the Northwest boundary SP 2 �� oe

rod set as per deed the West corner of that certain parcel
of land conveyed to the City of Corpus Christi by Paul F.
Ocker and wife Lillie B. Ocker, filed for record June 22,
1966, and recorded in Volume 1155, Pages 356-358, Deed
Records of Nueces County, Texas, and a corner of this
survey;
THENCE South 61°29'45" East, along the Southwest boundary
line of the City of Corpus Christi parcel, at 2.75 feet pass
a 1 inch iron pipe found on line to mark the West corner of
said City parcel as staked on the ground, in all a distance
of 32.75 feet to a 1 inch iron pipe found for a corner of
said City parcel and an inside corner of this survey;
THENCE North 29°03'20" East, along the boundary line of
said parcel of land belonging to the City of Corpus Christi,
15.00 feet to a 5/8 inch iron rod set for an inside corner
of said parcel and the North corner of this survey;
THENCE South 61°29'45" East, along the Southwest boundary
line of that certain parcel belonging to the City of Corpus
Christi, parallel with the common boundary line of Lots 2
and 3, said Section 4, Bohemian Colony Lands thereof and
25.00 feet distant therefrom, measured at right angles
thereto, 684.25 feet to a 5/8 inch iron rod set for a corner
of said parcel and an inside corner of this survey;
THENCE North 29°03'20" East, along the boundary line of said
parcel, 15.00 feet to a 5/8 inch iron rod set for an inside
corner of that certain parcel and a corner of this survey;
THENCE South 61°29'45" East, continuing along the Southwest
boundary line of said parcel belonging to the City of Corpus
Christi, parallel with the Southwest subdivision line of
Lexington Center, a map of which is recorded in Volume 11,
Page 2, Map Records of Nueces County, Texas, same being the
Northeast boundary line of said Lot 1, Block 9, therof and
10.00 feet distant therefrom, measured at right angles
thereto, 783.00 feet to a 5/8 inch iron rod set on the
Southeast boundary line of said Lot 1, Block 9, Lexington
Center for the South corner of said parcel belonging to the
City of Corpus Christi and an inside corner of this survey;
THENCE North 29°03'20" East, along the Southeast boundary
line of said City parcel and the Southeast boundary line of
said Lot 1, Block 9, 10.00 feet to a 5/8 inch iron rod set
on the Southwest subdivision line of said Lexington Center
(Volume 11, Page 2) for the upper East corner of said Lot 1,
Block 9, East corner of said City parcel and a corner of
this survey;
THENCE South 61°29'45" East, along the Southwest subdivision
line of said Lexington Center (Volume 11, Page 2) and the
northeast boundary line of Lot 3, Section 4, Bohemian Colony
Lands, 128.40 feet to a 1/2 inch iron rod found on the
Northwest boundary line of Ayers Street for the East corner
of this survey;
THENCE South 02°41"44" West, along the Northwest line of
Ayers Street, 120.00 feet to a 1/2 rod found for a corner of
Ayers Street and a corner of this survey;
THENCE South 13°01'18" West, continuing with said Northwest
boundary line of Ayers Street, 149.80 feet to a 1/2 inch
iron rod for a corner of Ayers Street and a corner of this
survey;
THENCE South 23°48'14" West, along said Northwest line of
Ayers Street, 131.90 feet to a 5/8 inch iron rod set for a
corner of Ayers Street and a corner of this survey;
THENCE South 28°50'44" West, along the above mentioned
Northwest line of Ayers Street, 332.00 feet to a broken
concrete monument found for an angle point in said Northwest
line of Ayers Street and an inside corner of this survey;
THENCE continuing with said boundary line of Ayers Street,
South 61°09'16" East 113.53 feet to a broken concrete
monument found on the Northwest boundary line of Ayers
Street for a corner of this survey;
THENCE South 29°02'25" West, along the Northwest boundary
line of Ayers Street, 133.27 feet to a 5/8 inch iron rod set
for the South corner of this survey;
THENCE North 61°30'10" West, leaving the Northwest line of
Ayers Street, at 350.00 feet pass a 5/8 inch iron rod found
on line to mark the South corner of said Lot 1, Block 9,
Lexington Center, and continuing North 61°30'10" West, along
the Southwest boundary line of said Lot 1, Block 9, in all a
distance of 1850.00 feet to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1973, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed a

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
