CLOSING AND ABANDONING THE 10 FOOT WIDE UTILITY EASEMENT IN
LOT 11, BLOCK 5, RIVER CANYON UNIT 2; SUBJECT TO PROVISIONS
LISTED BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, there exists the 10 foot wide utility easement in Lot 11,
Block 5, River Canyon Unit 2, shown by plat in Volume 48, Page 148, Map Records,
Nueces County, Texas; and

SECTION 1. That there is hereby closed and abandoned the 10 foot wide
utility easement in Lot 11, Block 5, River Canyon Unit 2, shown by plat in
Volume 48, Page 148, Map Records, Nueces County, Texas, providing that said
Lots 11 and 12, Block 5, be replatted with a 10 foot wide utility easement
centered on their common lot line.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid utility easements, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this
the 21st day of December, 1983.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
