HomeMy WebLinkAbout18002 ORD - 12/21/1983TEXAS: AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH ATLEE M. CUNNINGHAM, P.E. FOR ENGINEERING SERVICES DURING THE DESIGN AND CONSTRUCTION OF THE CENTRALIZED MONITORING AND CONTROL. SYSTEM AT THE 0.N. STEVENS PLANT; APPROPRIATING $12,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be authorized to execute an agreement with Atlee M. Cunningham, P.E., for engineering services during design and construction of the Centralized Monitoring and Control System at the 0.N. Stevens Water Plant, a copy of which agreement is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That there is hereby appropriated $12,000 from the No. 205 Water Construction Bond Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 21st day of December, 1983. PROFESSIONAL ENGINEERING SERVICES THE STATE OF TEXAS § COUNTY OF NUECES § The City of Corpus Christi, hereinafter called "City", and Atlee M. Cunningham, P.E., hereinafter called "Engineer", agree as follows: I. SERVICES TO BE PERFORMED The Engineer hereby agrees to perform all engineering services related to project engineering during the planning and construction phase of the Supervisory Control Rehabilitation of the Water System Pumping Stations and Reservoirs. II. SCOPE OF SERVICES The services of the Engineer shall include but not be limited to the following: A. Construction Documents Phase Provide plans and specifications for telemetry, instruments and control loops, and motor operated plug valves for the pump stations and reservoirs. B. Design Phase Serve as project engineer to consult with and advise the City's Electrical Design Engineer during the planning phase of the electrical design and microwave transmission system design. C. Construction Phase 1. Consult with and advise the City in the selection of instruments, supervisory equipment, and other items to be purchased by the City. 2. Consult and advise the City's representatives during the installation of the low voltage wiring, instrumentation and telemetry. 3. Consult and advise the City's representatives and electrical engineer during the 120-480 volt installation and microwave system installation. 4. Keep detailed records of the progress of construction. 5. Comment and review with electrical engineer on electrical drawing prior to approval. 6. Provide field control of all field testing programs. Review all monthly estimates by electrical contractor prior to submittal to the City. 9. Assist City and Electrical Engineer in final inspection of the project. 1 10. Provide monthly reviews of the contractor's payroll to insure compliance with the minimum wage requirements of the contract. III. ENGINEERING FEES FOR SERVICES The City and the Engineer agree that the total fee shall be Twelve Thousand and no/100 Dollars ($12,000.00) for services performed. Monthly payments will be made upon submissions of invoices by the Engineer. IV. DISCLOSURE STATEMENT The Engineer agrees, in compliance with City Ordinance No. 17112, to complete the Disclosure of Interests form attached hereto and made a part hereof. V. TRANSFER OF INTERESTS The Engineer shall not assign or transfer any interests in this contract without prior written consent from the City. VI. CONTRACT TERMINATION The City reserves the right to terminate this contract at any time, with or without cause. In the event of such termination, the Engineer will be paid a sum proportionate to the state of completion of the work. "Board member." A member of any board, commission, or committee appointed by the City Council of the City of Corpus Christi, Texas. b. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or parttime basis, but not as an independent contractor. c. "Firm." Any entity operated for economic gain, whether professional, industrial or commercial, and whether established to produce or deal with a product or service, including but not limited to, entities operated in the form of sole proprietorship, as self-employed person, partnership, corporation, joint stock company, joint venture, receivership or trust, and entities which for purposes of taxation are treated as non-profit organizations. d.
