AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH BATH &
ASSOCIATES, INC. FOR ENGINEERING SERVICES RELATED TO THE
ELECTRICAL DESIGN OF THE CENTRALIZED MONITORING AND CONTROL
SYSTEM AT THE O.N. STEVENS PLANT; APPROPRIATING $29,750; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an
agreement with Bath & Associates, Inc. for engineering services related to the
electrical design of the Centralized Monitoring and Control System at the O.N.
Stevens Water Plant, a copy of which agreement is attached hereto and made a
part hereof marked Exhibit "A".
SECTION 2. That there is hereby appropriated $29,750 from the No. 205
Water Construction Bond Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
immediate action to preserve and protect public property by expediting the
construction of public improvements, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings so that this ordinance
is passed and shall take effect upon first reading as an emergency measure this
the 21st day of December, 1983.

CONTRACT
PROFESSIONAL ENGINEERING SERVICES
THE STATE OF TEXAS §
COUNTY OF NUECES §
The City of Corpus Christi, Texas, hereinafter called "City", and Bath &
Associates, Inc., hereinafter called "Engineer", agree as follows:
I. SERVICES TO BE PERFORMED
The Engineer hereby agrees, at his own expense, to perform all
architectural, structural, mechanical, electrical, site work, design and
related services necessary to properly develop design plans and specifications
for the Supervisory Control Rehabilitation of the Water System Pumping
Stations as specified in Exhibit 'A' attached hereto and made a part hereof.
II. SCOPE OF SERVICES
The Engineer agrees to perform, for the above named work,
professional services as hereinafter set forth:
A. Construction Documents Phase
1. Prepare complete working drawings and technical
specifications setting forth in detail the requirements for rehabilitating the
facilities outlined in Article I.
2. Submit a cost estimate.
3. Submit, to the City, three (3) complete sets of the documents
as outlined in Item A-1 for review by the City.
B. Bidding and Contract Phase
1. Upon approval of the Construction Documents by the City,
provide the City with reproducible copies of the documents required in
Section A.

to the City. In the event the lowest acceptable bid exceeds the estimated
cost, the Engineer shall confer with the City and make such revisions as is
satisfactory for the readvertising of bids, without increases in the Basic
Fee.
C. Construction Phase
1. Be the City's representative during the construction period

which begins with the award of the contract and .extends until the final
acceptance of the project.
2. Provide the general administration of construction including
periodic visits to the sites to familiarize the Engineer generally with the
progress and quality of the work and to determine in general if the work is
proceeding in accordance with the contract. The Engineer will endeavor to
guard the City against defects and deficiencies in the work of contractors,
but the Engineer does not guarantee the performance of their contrcts.
3. Have the authority to stop work whenever such stoppage may be
necessary in the Engineer's reasonable opinion to insure the proper execution
of the contract and may condemn work as failing to conform to the contract.
4. Not be required to make exhaustive or continuous on-site
inspections normally defined as resident inspection, but will make those
inspections necessary to certify that to the best of the Engineer's knowledge
work has progressed to the point indicated, the quality of the work is in
accordance with the construction contract, and the contractor is entitled to
payment.
5. Check shop and working drawings when required and furnished
by contractor.
6. Conduct final inspection.
7. Represent the City in interpreting and rendering decisions on
the requirements of the contract documents and claims or disputes between the
contractor and the City, to include any disputes made by the City against the
contractor within one year of the final inspection.
D. As -Built Drawings and Maintenance Manuals
1. The Engineer shall furnish to the City, upon completion of
said project, or upon termination of this contract as herein provided, a
suitable bound copy of the specifications and a reproducible set of working
drawings on mylar or tracing paper, including any and all corrections,
revisions, alterations or amendments to the plans and/or specifications made
during the Construction Phase so as to reflect the true plans and
specifications of the facilities as built.
2. The Engineer shall use 24" x 36" sheet sizes of 3 mil mylar
or tracing paper for the "as -built" drawings which are to be submitted as
described above.
3. The Engineer shall furnish to the City, upon project

completion, operating manuals or instructions, parts lists, or maintenance
manuals for all mechanical, electrical or any other equipment installed on the
project.
4. The City will not make final payment to the Engineer until
the conditions of Section D are met.
E. Cooperation with Project Coordinator
The Engineer agrees to cooperate fully with the City's Project
Coordinator, Atlee M. Cunningham, P.E., for the duration of this project.
F. Transfer of Interest
The Engineer shall not assign or transfer any interest in this
contract without prior written consent from the City.
G. Orderly Rendering of Services
The Engineer shall furnish the document required in each phase of
the design and personally render or provide the service required in this
contract in the sequence and times herein indicated and as may be necessary to
insure the prompt and continuous prosecution of the work of designing and
constructing the project. It is understood that all designs and details of
designing are subject to the approval of the City, and until the acceptance of
results of these services, there shall be no liability on the part of the City
for such services. The Engineer agrees to furnish items required of
Construction Documents Phase to the City by March 30, 1984.
H. Cost Estimates
The Engineer is to provide an estimate of costs at the time of
submission of the Construction Documents Phase, but does not guarantee the
accuracy of such estimates. The City will have the right to require the
Engineer to make revisions to the Construction Documents so as to bring the
cost within funds available at no additional fee.
III. COMPENSATION
The City and Engineer agree to the hourly rates specified in the
schedule identified as Exhibit '8' attached hereto and made a part hereof.
The total fee shall not exceed Twenty-three Thousand and no/100 ($23,000.00)
Dollars, Monthly payments will be made upon submission of invoices by the
Engineer.
IV. DISCLOSURE STATEMENT
The Engineer agrees, in compliance with City Ordinance No. 17112, to
complete the Disclosure of Interests form attached hereto and made a part
hereof.

V. CONTRACT TERMINATION
The City reserves the right to terminate this contract at any time,
with or without cause. In the event of such termination, the Engineer will be
paid a sum proportionate to the state of completion of the work.
VI. CHANGE IN SCOPE OF ENGINEERING SERVICES
In the event that a change in the scope of Engineering Services is
authorized by the City to include the design of additive alternates specified
in the schedule identified as Exhibit 'A', the City and the Engineer agree to
the fee as follows:
The City will pay the Engineer for the authorized work at the hourly
rates specified in the schedule identified as Exhibit 'B' attached hereto and
made a part hereof. The total fee for this additional work shall not exceed
Six Thousand Seven Hundred Fifty and no/100 ($6,750.00) Dollars.
VII. ENGINEER'S LIABILITY
Acceptance and approval of the final plans by the City shall not
constitute nor be deemed a release of the responsibility and liability of the
Engineer, its employees, associates, agents and consultants, for the accuracy
and competence of their designs, working drawings, and specifications or other
documents and work, nor shall such approval be deemed to be an assumption of
such responsibility by the City for any defects in designs, working drawings,
and specifications or other documents prepared by the Engineer, its employees,
subcontractors, agents and consultants.

SUPERVISORY CONTROL REHABILITATION
WATER SYSTEM PUMPING STATIONS
BASIC SYSTEM DESIGN
Design the installation of the following:
0. N. Stevens Plant
1. 120 volt power to the new equipment at the control center in the
Filter Building.
2. Underground signal cable from Production Superintendent's office to
control center in the Filter Building.
Savage Lane Pumping Station
1. 120-480 volt wiring for five (5) motor operated plug valves for
remote and local operation.
2. Modification of the motor controller for the installation of
4 - 20mA output transducers for remote current and voltage readings
and for remote operation.
3. 120 volt connections for the new instrumentation and supervisory
equipment.
4. 480 volt switchgear to power valve operators.
5. Sump water level probes for high water alarm.
6. Remote signal for emergency generator.
7. Trespass alarm with remote signal.
8. Security light with remote signal.
9. Conduit and shielded cable from flow transmitter to the instrument
panel.
10. Modifications or additions necessary for the use of FSK
transmission of signals.
Caldwell Pumping Station
1. Sump water level probe for high water alarm with remote signal.
2. Trespass alarm with remote signal.
3. 120 volt wiring for powering the telemetering transmitter.
4. Modification of voltage and current indicators for remote use by
