HomeMy WebLinkAbout18028 ORD - 01/11/1984 (2)AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF INSCO `DISTRIBUTING, INC. BY GRANTING A SPECIAL COUNCIL PERMIT FOR A SHOWROOM ON A PORTION OUT OF LOT 2, SECTION 5, BOHEMIAN COLONY LANDS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Insco Distributing, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 11, 1984, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. • SECTION 2. That a Special Council Permit for a showroom be granted on a portion of Lot 2, Section 5, Bohemian Colony Lands, more fully described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, as shown in the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A". FIELDNOTES for 61,246.64 square feet of land out of Lot 2, Fractional Section 5, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point on the centerline of Greenwood Drive which is also the common boundary line of Lot 6, Section 4 and Lot 2, Fractional Section 5 for the East corner of this tract from which corner the common corner of Lots 1, 2, Fractional Section 5 and Lots 6, 7, Section 4 bears with said centerline North 29°00'00" East 418.63 feet; MICINEILmED SEP 28 !arm 1 O28 THENCE South 29°00'00" West, along the centerline of Greenwood Drive and the common boundary line of said Section 4 and Fractional Section 5, 175.00 feet to a point for the South corner of this tract; THENCE North 61°36'00" West, leaving said centerline, at 40.00 feet pass the Northwest right-of-way line of said Greenwood Drive whence the East corner of Lot 10, Block 1, Cedar Grove, a map of which is recorded in Volume 48, Page 73 of said map records bears South 29°00'00" West 60.00 feet, in all a distance of 350.00 feet to a point on the Southeast boundary line of the City of Corpus Christi 25.06 acre tract for the West corner of this tract; THENCE North 29°00'00" East, along the Southeast line of said 25.06 acre tract, 175.00 feet to a point for the North corner of this tract; THENCE South 61°36'00" East, at 310.00 feet pass the aforementioned Northwest right-of-way line of Greenwood Drive, in all a distance of 350.00 feet to the POINT OF BEGINNING, containing 61,246.64 square feet of land of which 6,999.62 square feet are contained within said 40.00 feet of Greenwood Drive for a net square footage of 54,247.02 square feet of land. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or re utions at three regular meetings so that this ordinance is passe and shall to effect on first 1ye7ding as an emergency measure this the y of MAYOR APPR / b DAY OF J.
