HomeMy WebLinkAbout18061 ORD - 01/25/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF OMNI INTERESTS, INC. BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 6, SECTION 4, AND A PORTION OF LOT 5, SECTION 4, BOHEMIAN COLONY LANDS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "6-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Omni Interests, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, January 25, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lot 6, Section 4, and a portion out of Lot 5, Section 4, Bohemian Colony Lands, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "B-4" General Business District. Being a tract of land containing 148.975 acres of land, more or less, being all of Lot 6, Section 4, and a portion of Lot 5, said Section 4, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, of the Map Records of Nueces County, Texas, said portion of Lot 5 as further described by metes and bounds as follows: BEGINNING at a 5/8" iron rod found in the centerline of Greenwood Drive at the Northernmost corner of said Lot 5 for the Northernmost corner of this tract; THENCE along the Northeast boundary line of said Lot 5 S 61°00'00" E 2640.00 feet to a 5/8" iron rod found for the Easternmost corner of said Lot 5 and an Easternmost corner of this tract; SEP 2 8 19cgof 113061 THENCE along the Southeast boundary line of said Lot 5 S 29°00'00" W 999.00 feet to a 5/8" iron rod found at the Easternmost corner of a subdivision called Holly Road Industrial Tracts for the Southernmost corner of this tract; THENCE along the Northeast boundary line of said Holly Road Industrial Tracts N 61°00'00" W 1333.33 feet to a 5/8" iron rod found at the Northernmost corner of said Holly Road Industrial Tracts for a central corner of this tract; THENCE S 29°00'00" W 281.00 feet to a 5/8" iron rod found in the centerline of Holly Road for a central corner of this tract; THENCE along said centerline of Holly Road N 61°00'00" W 1306.67 feet to a 5/8" iron rod found in the centerline of Greenwood Drive and being in the Northwest boundary line of said Lot 5; THENCE along said Northwest boundary line of Lot 5 being the centerline of Greenwood Drive N 29°00'00" E 1280.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspensio�if the Charter rule as to consideration and voting upon ordinances or resol •ns at three regular meetings so that this ordinance is passe and, shall to effect upon first r ading as an emergency measure this the day of �'� , 197 ATT /ESSTT �� Ci y SCSecretary APPR AY OF J. For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
