HomeMy WebLinkAbout18078 ORD - 02/08/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.61, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS TRACTS 1 AND 2, OUT OF LOT 5, SECTION 11, BOHEMIAN COLONY LANDS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Jack Ryan for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, February 8, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "A-1" on Tract 1, and "R -1C" on Tract 2, out of Lot 5, Section 11, Bohemian Colony Lands, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by 'adding a new subsection, 31-5.61 to hereafter read as follows, such zoning classification of the hereinafter cTescribed properties to be effective upon annexation: "Section 31-5.61 . The following described tracts of land shall be zoned and classified as fo lows: SEP 2 81984 18078 "'1i•• HHc dtaL i� t Tract 1 "A-1" Apartment House District on the following more particularly described tract: FIELDNOTES for 12.58 acres of land out of Lot 5, Section 11, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a spike set on the centerline of Weber Road marking the common corner of Lot 4, Lot 5, said Section 11 and Lot 3, Lot 4, Section 12, Bohemian Colony Lands for the West corner of this survey; THENCE North 29°00'00" East, along the common boundary line of Lot 5, Section 11, and Lot 3, Section 12, and the centerline of Weber Road, 660.00 feet to a point for the North corner of this survey; THENCE leaving said centerline, South 61°32'00" East, at 50.00 feet pass the Southeast right-of-way line of said Weber Road, in all a distance of 830.00 feet to a point for the East corner of this survey; THENCE South 29°00'00" West 660.00 feet to a point on the common boundary line of said Lot 4 and Lot 5, Section 11 for the South corner of this survey; THENCE North 61°32'00" West, along the common boundary line of said Lot 4 and Lot 5, Section 11, 830.00 feet to the POINT OF BEGINNING. Tract 2 "R -1C" One -family District on the following more particularly described tract: FIELDNOTES for 22.55 acres of land out of Lot 5, Section 11, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING on the common boundary line of said Lot 5 and Lot 4, Section 11, said Bohemian Colony Lands, for the West corner of this survey, from which a spike set on the centerline of Weber Road marking the common corner of Lot 4 and Lot 5, said Section 11, and Lot 3 and Lot 4, Section 12, said Bohemian Colony Lands bears North 61°32'00" West 830.00 feet; THENCE leaving the abovementioned common boundary line, North 29°00'00" East, 660.00 feet to a point for the North corner of this survey; L THENCE South 61°32'00" East, 1700.59 feet to a point on the Northwest boundary line of the 160.00 foot wide City of Corpus Christi Schanen Drainage right-of-way for the East corner of this survey and the point of curvature for a circular curve to the right whose radius point bears North 30°35'37" West, 207.94 feet and has a central angle of 02°14'37", a radius of 207.94 feet, a tangent distance of 4.07 feet, and an arc length of 8.14 feet; THENCE with said curve to the right along the abovementioned drainage right-of-way 8.14 feet for the point of tangency; THENCE South 61°39'00" West continuing along the Northwest boundary line of said 160.00 foot wide drainage right-of-way 780.32 feet to a point on the aforementioned common boundary line of said Lots 4 and 5, Section 11, for the South corner of this survey; THENCE North 61°32'00" West, along the abovementioned common boundary line 1275.32 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is a pp,sstd andn of e ffect upon 1ir reading as an emergency measure this the ]jYT� y 1461441 , ATTEST: // ec Ci Secretary APAED: X jS'f� DAY 0 J.
