HomeMy WebLinkAbout18093 ORD - 02/14/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TRISTAR DEVELOPMENT COMPANY BY CHANGING THE ZONING MAP IN REFERENCE TO TRACT 1 BEING LOT 2 OF A RESUBDIVISION OF THE WEST ONE-HALF OF LOT 26 AND PORTION OF LOT 27, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS AND TRACT 2, BEING A PORTION OF LOT 27, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "B-1" NEIGHBORHOOD BUSINESS DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT ON TRACT 1 AND FROM "A-1" APARTMENT HOUSE DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tristar Development Company for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, February 15, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Tract 1 being Lot 2 of a Resubdivision of the West One -Half of Lot 26 and Portion of Lot 27, Section 13, Flour Bluff and Encinal Farm and Garden Tract, be changed from "B-1" Neighborhood Business District to "B-4" General Business District. SECTION 3. That the zoning of Tract 2 being a portion of Lot 27, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "A-1" Apartment House District to "B-1" Neighborhood Business District. FIELDNOTES for 0.97 acres of land out of Lot 27, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas; said 0.97 acre tract known as the SEP 2 81984 15°93 MICROFILMED Ray Cox Tract and shown in Volume 21, Page 55, of said Map Records; BEGINNING at an angle point in the Northeast boundary line of Holly Road for the South corner of said 0.97 acre tract and the South corner of this tract from which corner the West corner of Lot 2 of the Resubdivision of the West one-half of Lot 26 and Portion Lot 27, Section 13, Flour Bluff and Encinal Farm and Garden Tract, a map of which is recorded in Volume 21, Page 55, of said Map Records bears North 29°00'00" East 10.00 feet; THENCE North 61°00'40" West, along the Northeast boundary line of Holly Road (40.00 feet wide), parallel with the centerline of the Naval Air Station Railroad right-of-way thereof and 60.00 feet distant therefrom, measured at right angles thereto, 363.00 feet to an angle point in said Holly Road for the West corner of the Ray Cox 0.97 acre tract and the West corner of this tract; THENCE North 29°00'00" East, along the boundary line of said Holly Road and the Northwest boundary line of said 0.97 acre tract, at 20.00 feet pass a corner of said Holly Road also marking the South corner of Lot 28, Block 2, Gulfway - Airline Park, a map of which is recorded in Volume 38, Page 84, Map Records of Nueces County, Texas, and continuing North 29°00'00" East, along the common boundary line of the Ray Cox Tract (Volume 21, Page 55) and said Lot 28, Block 2, in all a distance of 116.76 feet to the West corner of said Lot 1 (Volume 21, Page 55) for the North corner of said Ray Cox Tract and the North corner of this tract; THENCE South 61°00'00" East, along the Southwest boundary line of said Lot 1 and the Northeast boundary line of the Ray Cox 0.97 acre tract, 363.00 feet to a point on the Northwest boundary line of said Lot 2 for the upper South corner said Lot 1 and the East corner of the Ray Cox Tract for the East corner of this tract; THENCE South 29°00'00" West, along the Southeast line of the Ray Cox Tract and the Northwest line of said Lot 2, at 106.69 feet pass the aforementioned West corner of said Lot 2, in all a distance of 116.69 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
