HomeMy WebLinkAbout18094 ORD - 02/22/19841 1� AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO PARCELS 3, 4, 6, 7, 8, 9, and 10 FOR THE CITY HALL SITE AND TO ACQUIRE SAID PARCELS FROM THE FEE OWNERS AND ALL OTHERS OWNING INTERESTS THEREIN, AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for an on behalf of the City, certain parcels or tracts of land, more fully described hereinafter; and WHEREAS, the City Hall Site requires the acquisition of fee simple title in and to the said parcels or tracts; and WHEREAS, it is therefore determined by the City Council that there exists a public purpose and public necessity that the said parcels or tracts be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that upon the expiration of thirty days eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described lands and premises, excluding mineral interests, for use by the City for the City Hall Site, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcels or tracts of land, excluding mineral interests, said parcels being described as follows: No. 3: Tract I - The West sixty feet (W 60') Lot Six (6), Block Forty five (45), Bluff Portion; and Tract II - Lots Seven (7) through Nine (9), Block Forty five (45), Bluff Portion. No. 4: Tract I - The West One Hundred forty five feet (W 145') Lot Five (5), Block Forty five (45), Bluff Portion, save and except the North 0.12' of the East 85'; and MICROFILMED SEP 2 81984 18094 1, Tract II - The East Eighty five feet (E 85') of Lot Six (6), Block Forty five (45), Bluff Portion, save and except the North ten feet (N 10'). No. 6: Lot One (1), Block Forty five (45), Bluff Portion, save and except the East Five feet (E 5'). No. 7: Lots Eight (8) through Fourteen (14), Block Forty four (44), Bluff Addition. No. 8: Lot Seven (7), Block Forty four (44), Bluff Portion, save and except the East Five feet (E 5'). No. 9: Lots Three (3) through Six (6), Block Forty four (44), Bluff Portion, save and except that strip on the East side thereof described in deed dated December 1, 1967 recorded in Volume 1247, Page 357 Deed Records, Nueces County, Texas. No. 10: Tract I - Lot One (1), Block Forty four (44), Bluff Portion, save and except that strip off of the East side thereof as described in deed dated December 1, 1967 recorded in Volume 1248, Page 165 and Volume 1251, Page 156, Deed Records, Nueces County, Texas; and Tract II - Lot Two (2), Block Forty four (44), Bluff Portion, save and except a strip of land off the East side thereof as described in deed dated December 1, 1967 recorded in Volume 1248, Page 169, Deed Records, Nueces County, Texas. All of which parcels and lots are shown by map or plat thereof as recorded in Volume A, Page 3, Map Records, Nueces County, Texas. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein no sooner than thirty days from the date of this ordinance, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for expediting construction of public improvements by acquisition of the aforesaid parcels, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and hall take ect upon first reading as an emergency ZZ measure this the dayof 4411 , 1984.
