HomeMy WebLinkAbout18101 ORD - 02/22/1984AN ORDINANCE CLOSING AND ABANDONING 60 FOOT WIDE BLUCHER STREET FROM THE EAST RIGHT-OF-WAY OF CARRIZO STREET TO THE WEST RIGHT-OF-WAY OF NORTH TANCAHUA STREET; PROVIDING CONDITIONS THEREFOR; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of 60 foot wide Blucher Street from the east right-of-way of Carrizo Street to the west right-of-way of North Tancahua Street, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on February 22, 1984, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of right-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights of way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned 60 foot wide Blucher Street from the east right-of-way of Carrizo Street to the west right-of-way of North Tancahua Street, providing that the south one-half (30 feet wide) be retained as a utility easement, providing that the 12" water line and 8" gas line in the north one-half of Blucher Street be relocated, providing that the Southwestern Bell Telephone conduit currently within the north one-half of the subject right-of-way be allowed to remain provided that (a) it will not affect the structural system of the proposed new main library, (b) no additional cost will be involved for the foundation of the library as a result of leaving the conduit in place, and (c) a hold harmless agreement with the City is executed by Southwestern Bell Telephone Company should it be determined that the conduit should remain in its present position. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the closing of that portion of Blucher Street described above for the construction of public improvements, such finding of an emergency is made and declared SEP 2819 4 MICROFILMED 18101 requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 22nd day of February, 1984.
