AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.63, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS TRACTS 1, 2, 3, 4, AND 5, OUT OF LOTS 3-8,
SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS;
AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Nueces Development
Company for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Wednesday, February 29, 1984, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-1" on Tract 1,
"A-1" on Tract 2, "R -1B" on Tracts 3 and 5, and "R -1C" on Tract 4, out of Lots
3-8, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County,
Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.63 to hereafter read
as follows, such zoning classification of the hereinafter described properties
to be effective upon annexation:

"Section 31-5.63. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"B-1" Neighborhood Business District on the following more
particularly described tract:
Description of 8.620 acres of
portion of Lot 8, Section 6,
and Garden Tracts as shown by
Pages 41-43, Map Records of
further described by metes and
land, more or less, out of a
Flour Bluff and Encinal Farm
plat recorded in Volume "A",
Nueces County, Texas, and
bounds as follows:
BEGINNING at a 5/8" iron rod found at the intersection of
the Northeast boundary line of said Lot 8 and Northwest
right-of-way line of South Staples Street for the
Easternmost corner of this tract, said beginning point being
located N 61°00'41" W 40.00 from the Easternmost corner of
said Lot 8;
THENCE S 28°56'02" W 988.902 feet along said Northwest
right-of-way line of South Staples Street to a 5/8" iron rod
found for the Southernmost corner of this tract;
THENCE N 61°03'09" W 380.00 feet to a 5/8" iron rod set for
the Westernmost corner of this tract;
THENCE N 28°56'02" E 988.29 feet to a 5/8" iron rod set in
the Northeast boundary line of said Lot 8 for the
Northernmost corner of this tract;
THENCE S 61°00'41" E 380.00 feet along said Northeast
boundary line of Lot 8 to the POINT OF BEGINNING.
Tract 2
"A-1" Apartment House District on the following more particularly
described tract:
Description of 6.861 acres of land, more or less, out of a
portion of Lots 7 and 8, Section 6, Flour Bluff and Encinal
Farm and Garden Tracts as shown by plat recorded in Volume
"A", Pages 41-43, Map Records of Nueces County, Texas, and
further described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod set in the Northeast boundary
line of said Lot 8 which bears N 61°00'41" W 420.00 feet
from a 1" iron bolt found at the Easternmost corner of said
Lot 8, said beginning point for the Easternmost corner of
this tract;
THENCE S 28°56'02" W 988.29 feet to a 5/8" iron rod set for
the Southernmost corner of this tract;
THENCE N 61°03'09" W pass the common boundary line between
said Lots 7 & 8 in all a distance of 250.07 feet to a 5/8"
iron rod set for the Westernmost corner of this tract;
THENCE N 22°15'36" E 70.48 feet to a 5/8" iron rod set for a
Westerly corner of this tract;
THENCE N 12°49'03" E 218.61 feet to a 5/8" iron rod set for
a Westerly corner of this tract;
THENCE N 21°23'05" E 141.23 feet to a 5/8" iron rod set for
a Westerly corner of this tract;

THENCE N 37°09'06" E 207.02 feet to a 5/8" iron rod set for
a Northerly corner of this tract;
THENCE N 46°13'05" E 143.05 feet to a 5/8" iron rod set for
a Northerly corner of this tract;
THENCE N 38°28'17" E 100.05 feet to a 5/8" iron rod set in
the Northeast boundary line of said Lot 7 for the
Northernmost corner of this tract;
THENCE S 61°00'41E 250.00 feet along said Northeast boundary
line of Lot 7 pass the common corner of said Lots 7 & 8 and
along said Northeast boundary line of Lot 8 to the POINT OF
BEGINNING.
Tracts 3 & 5
"R -1B" One -family Dwelling District on the following more particularly
described tract:
Description of 90.095 acres of land, more or less, out of
Lots 3, 4, 5, 6, 7, and 8, Section 6, Flour Bluff and
Encinal Farm and Garden Tracts as shown by plat recorded in
Volume A, Pages 41-43 of the Map Records of Nueces County,
Texas, and further described by metes and bounds as follows:
BEGINNING at an iron bolt found in the centerline of South
Staples Street for the Southeast corner of this tract and
being in the Southeast boundary line of said Lot 8;
THENCE N 61°03'09" W at 40.00 feet pass the Northwest
right-of-way line of said South Staples Street in all a
distance of 3,966.36 feet across said Lots 8, 7, 6, 5, 4, &
3 to a 5/8" iron rod set in the Northwest boundary line of
said Lot 3 for the Westernmost corner of this tract;
THENCE along said Northwest boundary line of Lot 3, N
28°55'40" E at 110.87 feet pass the Southernmost corner of
Creekway Subdivision as shown by plat recorded in Volume 47,
Pages 100 and 101 of said map records and along the common
boundary line between said Lot 3 and the Southeast boundary

144.82 feet;
THENCE along the arc of said circular curve to the right a
distance of 239.90 feet to a 5/8" iron rod set at the point
of tangency;
THENCE S61°00'41"E 524.87 feet to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon 19rs ,wading as an emergency measure this the Q? / day

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
