HomeMy WebLinkAbout18114 ORD - 03/07/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.64, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OF LOT 22, SECTION 5, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Interest Diversification Group, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, March 7, 1984, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "R -1C" on a portion out of Lot 22, Section 5, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.64 to hereafter read as follows, such zoning classification of (q he��nafter described properties to be effective upon annexation: WC/W."-llVV11 18114gr R 1°" "Section 31-5.64. The following described tracts of land shall be zoned and classified as fo lows: "R -1C" One -family Dwelling District on the following more particularly described tract: A 3.1806 acre tract of land, out of Lot 22, Section 5, of the Flour Bluff and Encinal Farm and Garden Tracts, a map is recorded in Volume A at Pages 41-43 of the Nueces County, Texas Map Records, a metes and bounds description follows: BEGINNING at a 5/8 inch iron rod found to mark the northeast or most east corner of Lot 22, Section 5, of the Flour Bluff and Encinal Farm and Garden Tracts as stated above, to mark the northeast corner of this tract and the place of beginning for this survey; THENCE, South 29°01'00" West, at 20.00 feet found a 5/8 inch iron rod marking the southwest line of County Road Number 26, in all 494.21 feet to a 5/8 inch iron rod found to mark the most south or southeast corner of this tract; THENCE, North 61°01'30" West, 280.35 feet to a 5/8 inch iron rod set to mark the most west or southwest corner of this tract; THENCE, North 29°01'00" East at 474.21 feet to a 5/8 inch iron rod on the southwest line of County Road Number 26, in all 494.21 feet to a 5/8 inch iron rod set to mark the most north or northwest corner of this tract; THENCE, on the centerline of County Road Number 26, the Northeast line of Lot 22, South 61°01'30" east, 280.35 feet to the PLACE OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon fir/st eading as an emergency measure this the 1c.Lday of y'I/�Qn ( , 19D .
