AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.62, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS TRACTS 1, 2, AND 3, OUT OF ANNEX NO. 1 TO
THE NUECES RIVER IRRIGATION PARK; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Nueces Development
Company for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Wednesday, March. 7, 1984, at Special
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "A-1" on Tracts 1
2 and "R-2" on Tract 3, out of Annex No. 1 to the Nueces River Irrigation Park,
Nueces County, Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to'
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that -to approve the hereinafter set' forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
,CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.62 to hereafter read
as follows, such zoning classification of the hereinafter described properties
to be effective upon annexation: sE? ti1984

"Section 31-5.62. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"A-1" Apartment House District on the following more particularly
described tract:
Description of 5.720 acres of land, more or less, out of
Annex No. 1 of the Nueces River Irrigation Park, a map of
which is recorded in Volume A, Page 55 of the Map Records of
Nueces County, Texas, said 5.720 acre tract being more fully
described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod set for the Southernmost corner
of this tract and bearing N 84°16'41" W 28.66 feet from a
5/8" iron rod set at the Northernmost corner of Coastal Bend
Subdivision, a map of which is recorded in Volume 47, Page
85 of the Map Records of Nueces County, Texas;
THENCE N 84°16'41" W 33.68 feet to a 5/8" iron rod set at
the Easternmost corner of a George Bagnall tract of land for
an Easterly corner of this tract;
THENCE N 84°16'39" W also being the Northeast boundary line
of said George Bagnall tract at 433.00 feet pass a common
corner between said George Bagnall tract and the Ernest
Bagnall tract, in all a distance of 733.00 feet to a 5/8"
iron rod set at the Northernmost corner of said Ernest
Bagnall tract for the Westernmost corner of this tract and
being in the Easterly right-of-way line of a Nueces County
Water Control & Improvement District No. 3 Canal Tract;
THENCE along said Easterly right-of-way line of Canal Tract,
N 10°04'11" E 325.07 feet to a 5/8" iron rod set for the
Northwest corner of this tract;
THENCE N 84°35'00" E 35.00 feet along said Easterly
right-of-way line of Canal Tract to a 5/8" iron rod set for
a Northwesterly corner of this tract;
THENCE S 84°09'00" E 352.00 feet to a 5/8" iron rod set for
a Northerly corner of this tract;
THENCE N 59°23'38" E 165.09 feet to a 5/8" iron rod set for
the Northernmost corner of this tract;
THENCE S 40°03'30" E 258.00 feet to a 5/8" iron rod set for
an Easterly corner of this tract;
THENCE S 02°56'39" E 250.85 feet to the POINT OF BEGINNING.
Tract 2
"A-1" Apartment House District on the following more particularly
described tract:
Description of 4.383 acres of land, more or less, out of
Annex No. 1 to the Nueces River Irrigation Park, a map of
which is recorded in Volume A, Page 55 of the Map Records of
Nueces County, Texas, said 4.383 acre tract being more fully
described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod set at the Easternmost corner
of Coastal Bend Subdivision, a map of which is recorded in
Volume 47, Page 85 of the Map Records of Nueces County,
Texas, for the Southernmost corner of this tract;
THENCE along the Northeast boundary line of said Coastal
Bend Subidivison N 84°18'43" W 565.86 feet to a 5/8" iron
rod set at the Westernmost corner of said Coastal Bend
Subdivision for a Westerly corner of this tract;
THENCE N 84°16'41" W 28.66 feet to a 5/8" iron rod set for
the Southwest corner of this tract;
THENCE N 02°56'39" W 250.85 feet to a 5/8" iron rod set for
the Northwest corner of this tract;
THENCE N 76°50'31" E 213.32 feet to a 5/8" iron rod set for
a Northerly corner of this tract;
THENCE S 85°45'00" E 175.00 feet to a 5/8" iron rod set for
a Northerly corner of this tract;
THENCE S 79°45'00" E 278.00 feet to a 5/8" iron rod set in
the Westerly boundary line of a Calallen Independent School
District tract of land for the Easternmost corner of this
tract;
THENCE S 09°51'00" W 300.00 feet along said Westerly
boundary line of Calallen Independent School District tract
to the POINT OF BEGINNING.
Tract 3
"R-2" Multiple Dwelling District on the following more particularly
described tract:
Description of 3.969 acres of land, more or less, out of
Annex No. 1 to the Nueces River Irrigation Park, a map of
which is recorded in Volume A, Page 55, of the Map Records
of Nueces County, Texas, said 3.969 acre tract as more fully
described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod set in a Westerly boundary line
of a Nueces Investment Company tract which bears S 09°51'00"
W 41.96 feet from a 5/8" iron rod found for the Westernmost
corner of Lot 11, Block 7, River Canyon Unit II, a map of
which is recorded in Volume 48, Pages 147 and 148 of the Map
Records of Nueces County, Texas, said beginning point for
the Northernmost corner of this tract;
THENCE along said Westerly boundary line of Nueces
Investment Company tract S 09°51'00" W 382.00 feet to a 5/8"
iron rod set for the Southeast corner of this tract;
THENCE N 87°09'00" W 270.00 feet to a 5/8" iron rod set for
a Southerly corner of this tract;
THENCE S 72°33'09" W 344.32 feet to a 5/8" iron rod set for
the Southernmost corner of this tract;
THENCE N 29°10'00" W 239.00 feet to a 5/8" iron rod set in a
Northerly boundary line of a 74.75 acre tract described in
Volume 1426, Page 140, of the Deed Records of Nueces County,
Texas, for the Westernmost corner of the tract herein
described;
THENCE along the Northerly boundary line of said 74.75 acre
tract to 5/8" iron rods found as follows:
N 84°19'45" E 152.00 feet;
N 70°07'00" E 474.20 feet; and
N 66°03'00" E 200.00 feet to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall ke effect upon 1irA reading as an emergency measure this the 7' day

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
