AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE
PORT OF CORPUS CHRISTI AUTHORITY FOR THE ANNEXATION OF
APPROXIMATELY 619 ACRES OF LAND ADJACENT TO THE SHIP
CHANNEL, NUECES COUNTY, TEXAS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi is
hereby authorized to execute a contract with the Port of Corpus Christi
Authority, a true copy of which contract is attached hereto and made a part
hereof, marked Exhibit "A".

ANNEXATION CONTRACT
THE STATE OF TEXAS §
KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES §
This Annexation Contract made and entered into by and between The Port
of Corpus Christi Authority of Nueces County, Texas, (hereinafter called
"Owner") and the City of Corpus Christi, Texas, a municipal corporation under
the laws of the State of Texas, (hereinafter called "City') for good and
valuable consideration in hand received by the parties respectively and upon the
covenants and conditions hereafter stated;
WITNESSETH:
The Owner is owner in fee simple (exclusive of oil, gas, and other
minerals) and of all existing rights, titles and interests therein of all the
following described property located in Nueces County, Texas, adjacent to and
adjoining the corporate limits of the City, lying wholly within the
extraterritorial jurisdiction of said City, and, in whole or in part, within
three hundred feet (300') of the City's present corporate limits, generally
delineated as "Navigation District Property" on the map attached hereto and
marked Exhibit "A", and being more particularly described as follows, to -wit:
BEGINNING at a point, the intersection of the existing Corpus Christi
city limit line, the existing Aransas Pass city limit line (the North
line of the existing Corpus Christi Ship Channel);
THENCE N 77°33'29" E with said North line of the Corpus Christi Ship
Channel being the existing city limit line of Aransas Pass,
established January 25, 1982, by "Final Judgment" No. 21819 in the
Court of San Patricio County, Texas, (156th Judicial District), a
distance of approximately 8,450 feet, to its intersection with a line
projected N 12°26'31" W from a point (designated "A") described in the
Final Decree of Cause No. 76-12-C of the District Court, 94th Judicial
District, Nueces County, Texas, dated March 30, 1977, for a corner;
THENCE S 12°26'31" E, continuing with the existing Aransas Pass city
line, an approximately distance of 200 feet to aforementioned point
"A", being on the centerline of said Corpus Christi Ship Channel for a
corner;
THENCE N 77°33'29" E, continuing with the existing Aransas Pass city
limit line and said centerline of the existing Corpus Christi Ship
Channel, an approximate distance of 5,850 feet to its intersection
with the existing one-half (1/2) mile extraterritorial jurisdiction
line of the City of Port Aransas (measured from an interior corner of
the existing Port Aransas city limit line, said interior corner being
the intersection of the Port Aransas city limit line and the
centerline of the existing Corpus Christi Ship Channel) bears N
77°33'29" E 2,058.99 feet more or less from designated point "B",
described in the aforementioned Final Decree of Cause No. 76-12-C, for
a corner;
THENCE with said Port Aransas one-half (1/2) mile extraterritorial
jurisdiction line, a curve to the left (in a general Southeasterly
direction) 1,060 feet more or less to its intersection with the South
boundary line of the Navigation District, the same being the Northerly
boundary line of Mustang Island established by survey described in
plat and field notes recorded in the office of the County Surveyor of
Nueces County, Texas, in Mustang Island Survey, Book 4, Pages 324-699,
for a corner;
THENCE S 72°53'07" W with said South boundary line of the Navigation
District property, 1,226.81 feet more or less, to a corner on said
line for a corner of this tract;
THENCE S 74°45'57" W, a distance of 1,658.94 feet more or less to a
point for a corner;
THENCE S 77°00'07" W, a distance of 1,710.08 feet more or less to a
point for a corner;
THENCE S 62°28'02" W continuing along said South boundary line of the
Navigation District property, a distance of 113.22 feet more or less,
to a point on the East line of "Piper Canal" for a corner:
THENCE S 62°28'02" E crossing "Piper Canal" and continuing along said
South_boundary line of the Navigation District property, 1,344.04 feet
.more or less to a point for a corner;
THENCE S 45°29'02" W, a distance of 1,754.56 feet more or less to a
point for a corner;
THENCE S 77°33'29" W, continuing with said South boundary line of the
Navigation District property, a distance of 5,220 feet more or less,
to its intersection with the present Corpus Christi city limit line
for a corner;
THENCE N 45°01'50" W with said present Corpus Christi city limit line
(the common Northeast line of State Tracts No. 347, 346, 345 & 344)
established by annexation Ordinance No. 11201 dated December 13, 1971,
a distance of 3,220 feet more or less, to the POINT OF BEGINNING.
Containing 619 acres of land more or less.
The City and Owner hereby agree that the above described land shall be
included within the corporate boundaries of the City and shall become a part
thereof, subject to the terms of Article I, Section 2, of the City Charter of
Corpus Christi, as amended, and as further prescribed by Ordinance No. 11139 of
the City, as amended.
The City and Owner further agree that as an essential part of the
consideration of this Contract and conditions to the City's executing the same,
that the Owner does not need and will not request or demand, and that the City
shall have no obligations to supply, City services to any of the above described
land. The foregoing shall also apply to any tracts of land which are leased,
the subject of an easement, or otherwise under the control of the Owner which
are currently owned by the State of Texas generally delineated as "State Land"
on the map attached hereto and marked Exhibit "A" and more specifically
described in Exhibit "8" attached hereto. Owner agrees that it will, at its own
expense, provide any and all necessary City services required by the development
of the "Navigation District Property" and the "State Land" subject to its lease,
easement or control as described above. (The obligation to provide such
services to "State Land" shall apply only for so long as the Owner has said land
under lease, easement or other form of control and shall terminate when Owner's
control of such land is terminated.)
Owner further agrees that all of the above conditions shall be binding
upon the successors and assigns of the said Owner and shall constitute covenants
running with the land.
WITNESS OUR HANDS in duplicate originals both of equal force and
effect this the day of March, 1984.

STATE LAND
BEGINNING at a point, the point of intersection of the Northerly boundary
line of Mustang Island (established by survey described in plat and field
notes recorded in the office of the County Surveyor of Nueces County, Texas,
in Mustang Island Survey, Book A, Pages 324-699) and the present Corpus
Christi City Limit Line (established by Annexation Ordinance No. 11201 dated
December 13, 1972) for the Westernmost corner of this tract;
THENCE N 77°33'29" E with said Northerly boundary line of Mustang Island,
(same being the Southerly boundary line of the existing Navigation District
Property), a distance of 5,200.00 feet more or less, to a point for a corner;
THENCE N 45°29'02" E continuing with said South boundary line of the Naviga-
tion District property, 1,754.56 feet more or less, to a point for a corner;
THENCE 62°28'02" E continuing with said South boundary, 1,344.04 feet more or
less, (crossing Piper Canal), to a point on the East line of said "Piper
Canal" for a corner:
THENCE S 12°24'15" E, along said East line of Piper Canal, a distance of
3,820.00 feet more or less, to a point on a line that is both 5,000.00 feet
South of and parallel to the centerline of existing Corpus Christi Ship
Channel, for a corner;
THENCE S 77°33'29" W along said line that is both 5,000.00 feet South of and
parallel to the centerline of existing Corpus Christi Ship Channel, (crossing
"Piper Canal"), 6,500.00 feet more or less, to a point on the aforementioned
existing Corpus Christi City Limit Line for a corner;
THENCE N 45°01'50" W along said present Corpus Christi City Limit Line, a
distance of 2,950.00 feet more or less, to the POINT OF BEGINNING.
Containing 467 acres more or less.
Save and except a total of approximately 10.58 acres of land more or less,
which is not public land but patented or unpatented privately owned land and
further described as follows:
An 8.69 acre tract, being Surveys No. 1, 2, 3, 4, & 5, Block 296, Mustang
Island, described in plat and field notes recorded in the office of the
County Surveyor of Nueces County, Texas, in Mustang Island Survey, Book 4,
Pages 695, 696, 697, 698 and 699.
A 1.89 acre tract being Survey No. 6, Block No. 292, Mustang Island, de-
scribed in plat and field notes recorded in the office of the County Surveyor
of Nueces County, Texas, in Mustang Island Survey Book 4, Page 661.
