HomeMy WebLinkAbout18156 ORD - 03/28/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CHARLES J. SMITH BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOTS 1 AND 2, BLOCK 1, NUECES RIVER IRRIGATION PARK FROM "F -R" FARM -RURAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Charles J. Smith for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, March 28, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of Lots 1 and 2, Block 1, Nueces River Irrigation Park, Nueces County, Texas, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "F -R" Farm -Rural District to "B-4" General Business District. BEING 3.126 acres of land, more or less, out of Lots 1 and 2, Block 1, of the Nueces River Irrigation Park, recorded in Volume A, Page 54, Map Records of Nueces County, Texas, and said 3.126 acre tract being more particularly described by metes and bounds as follows: BEGINNING at the northeast corner of this tract, said corner being at the intersection of the centerline of F.M. 624 and the northerly extension of the east boundary line of a 5.1404 acre tract recorded in Volume 1733, Page 645, Nueces County Deed Records; THENCE S 10°00'00" W along the east boundary of this tract, at 75.21 feet pass the south right-of-way line of F.M. 624, in all 717.31 feet, to the southeast corner of this tract; ORME) 181567,v4„.,i. THENCE N 84°15'00" W along the south boundary of this tract, 190.33 feet, to a 5/8 inch iron rod for the southwest corner of this tract; THENCE N 10°00'00" E, at 642.10 feet pass a 5/8 inch iron rod on the south R.O.W. line of F.M. 624, said rod bearing S 84°15'00" E, 356.00 feet along said R.O.W. line from a 5/8 inch iron rod at the northeast corner of a 1.556 acre tract described in Volume 228, Page 1331, Deed Records of Nueces County, Texas, in all 717.31 feet to the northwest corner of this tract being at the centerline of F.M. 624; THENCE S 84°15'00" E, along the centerline of F.M. 624, the same being the north boundary of this tract, 190.33 feet to the point of beginning and containing 3.126 acres of land, more or less, of which 0.328 acres are within the R.O.W of F.M. 624. THIS description has been prepared from deeds of record and Urban Engineering's survey of a 39.09 acre tract out of Lots 1 and 2, Block 1, Nueces River Irrigation Park dated November 1, 1983. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
