HomeMy WebLinkAbout18189 ORD - 04/18/1984AN ORDINANCE CLOSING AND ABANDONING A 50 FOOT WIDE UNNAMED STREET ADJACENT TO SHERWIN PLACE SUBDIVISION; A 5 FOOT WIDE DRAINAGE EASEMENT OUT OF LOT 10, BLOCK 1, SHERWIN PLACE, A 10 FOOT WIDE UTILITY EASEMENT OUT OF LOTS A, B, AND C, MT. VERNON SHOPPING CENTER, AND A 5 FOOT WIDE UTILITY EASEMENT OUT OF LOT C, MT. VERNON SHOPPING CENTER, ABANDONING TWO EASEMENTS; AND LISTING THE PROVISIONS THEREOF. WHEREAS, notice of the time and place for holding a hearing concerning the closing of •a 50 foot wide unnamed street adjacent to Sherwin Place Subdivision as dedicated and shown on the plat of Mt. Vernon Shopping Center, Lot D, and recorded in Volume 27, Page 27, Map Records of Nueces County, Texas; a 5 foot wide drainage easement out of Lot 10, Block 1, Sherwin Place; a 10 foot wide utility easement out of Lots A, B, and C, Mt. Vernon Shopping Center as recorded in Volume 20, Page 99, Map Records; a 5 foot wide utility easement out of Lot C, Mt. Vernon Shopping Center (Volume 20, Page 99); and a 25 foot and 5 foot wide utility easement out of Lot D, Mt. Vernon Shopping Center (Volume 27, Page 27) was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on March 28, 1984, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of right-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights of way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned a 50 foot wide unnamed street adjacent to Sherwin Place Subdivision as dedicated and shown on the plat of Mt. Vernon Shopping Center, Lot D, and recorded in Volume 27, Page 27, Map Records of Nueces County, Texas, provided said right-of-way be reverted, provided property is replatted at applicant's expense; that there is hereby closed and abandoned a 5 foot wide drainage easement out of Lot 10, Block 1, Sherwin Place; that there is hereby closed and abandoned a 10 foot wide utility easement out of Lots A, B, and C, Mt. Vernon Shopping Center as recorded in Volume 20, Page 99, Map Records; that there is hereby closed and abandoned a 5 foot wide utility easement out of Lot C, Mt. Vernon Shopping Center (Volume 20, Page 99); that there is hereby closed and abandoned a 25 foot and a 5 foot wide utility easement out of Lot D, Mt. Vernon Shopping Center (Volume 27, Page 27); that there is hereby abandoned an irregularly shaped utility easement conveyed to the City of Corpus Christi by E. S. Joslin and Roy Smith and recorded in Volume 865, Pages 70, 71, and 72, Dee Records of Nueces County, Texas; and MICRON -MU/ 18189 SEP 2 R 1094 there is hereby abandoned a 13.5 foot wide utility easement as referenced in Volume 676, Pages 525 and 526, Deed Records of Nueces County, Texas, as described by the attached metes and bounds, provided that the property is replatted at the applicant's expense, provided that a 10 foot wide utility easement is dedicated; provided the amount of $5,167.23 is paid to the City of Corpus Christi Gas Division to relocate a 4 inch gas line in said 10 foot easement; and provided that applicant make satisfactory arrangements with Central Power and Light Company and Southwestern Bell Telephone Company to relocate and/or remove existing facilities in easements to be abandoned.
