HomeMy WebLinkAbout18208 ORD - 05/09/1984AN ORDINANCE AMENDING CHAPTER 53, TRAFFIC, OF THE CODE OF ORDINANCES TO PROHIBIT THE CONSUMPTION OF ALCOHOLIC BEVERAGES WHILE OPERATING A MOTOR VEHICLE, PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 53, Traffic, of the Code of Ordinances of the City of Corpus Christi, Texas, be amended by adding thereto a new Section 53-13 which shall hereafter be and read as follows: Sec. 53-13. Consumption of Alcoholic Beverages. No operator of a motor vehicle shall knowingly or intentionally consume an alcoholic beverage while operating a motor vehicle in a public place. As used herein, (a) "alcoholic beverage" shall mean a beverage that contains more than one-half of one percent of alcohol by volume and that is capable of use for beverage purposes, either alone or when diluted; (b) "motor vehicle" shall mean a vehicle which is self-propelled; (c) "public place" shall mean any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways and the common areas and parking lots of parks, shopping centers, office buildings, schools, hospi- tals, apartment houses and transport facilities. SECTION 2. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such holding shall not affect the validity of the remaining portions of this ordinance. SECTION 3. The caption of this ordinance shall be published in a newspaper of general circulation in the City of Corpus Christi and shall become effective June 1, 1984 after its date of publication as provided by law. 18208 cRgEwp1984 That the foregoing ordinance wap, read for second reading on this the f1 Y7► day of following vote: Luther Jones Betty N.
