HomeMy WebLinkAbout18216 ORD - 05/02/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF JOHN TUCKER BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1, 2, 3, and 4 BEING PORTIONS OUT OF LOT 7, SECTION 8, BOHEMIAN COLONY LANDS FROM "I-2" LIGHT INDUSTRIAL DISTRICT, "I-2" LIGHT INDUSTRIAL DISTRICT WITH "SP" SPECIAL PERMIT, AND "R -1B" ONE -FAMILY DWELLING DISTRICT TO B-4" GENERAL BUSINESS DISTRICT ON TRACT 1, "AB" PROFESSIONAL OFFICE DISTRICT ON TRACT 2, "R-2" MULTIPLE DWELLING DISTRICT ON TRACT 3, AND "R -1C" ONE -FAMILY DWELLING DISTRICT ON TRACT 4; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of John Tucker for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 2, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Tracts 1, 2, 3, and 4, all out of Lot 7, Section 8, Bohemian Colony Lands, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District, "I-2" Light Industrial District with "SP" Special Permit, and "R -1B" One -family Dwelling District to "B-4" General Business District on Tract 1, "AB" Professional Office District on Tract 2, "R-2" Multiple Dwelling District on Tract 3, and "R -1C" One -family Dwelling District on Tract 4: Tract 1 FIELDNOTES for 11.4 acres, more or less, of land out of Lot 7, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of said Lot 7, Section 8, for the West corner of this tract from which corner a point on the centerline of Ayers Street 1821s MICROFILMED SEP 2 81994 (State Highway 286) for the West corner of said Lot 7, bears North 61°30'00" West 40.00 feet, more or less; THENCE, leaving said Southwest boundary of Lot 7, Section 8, North 29°00'00" East, parallel to the centerline of Ayers Street thereof and 40.00 feet distant therefrom, measured at right angles thereto, 660.00 feet, more or less, for the North corner of this tract; THENCE South 61°30'00" East 295.00 feet, more or less, for a corner of this tract; THENCE South 28°30'00" West 155.00 feet, more or less, for an inside corner of this tract; THENCE South 61°30'00" East 410.00 feet, more or less, for an angle point of this tract; THENCE South 36°04'16" East 209.54 feet, more or less, for the East corner of this tract; THENCE South 28°30'00" West 415.00 feet, more or less, to a point on the aforementioned Southwest boundary of Lot 7, Section 8, same being the Northeast subdivision line of Crestmont Unit 8, for the South corner of this tract; THENCE North 61°30'00" West, along said Southwest boundary line, 900.00 feet, more or less, for the POINT OF BEGINNING. Tract 2 FIELDNOTES for 1.5 acres, more or less, of land out of Lot 7, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at the North corner of this tract from which corner the West corner of said Lot 7, Section 8, bears North 61°30'00" West 335.00 feet, more or less, to a point on the centerline of Ayers Street (State Highway 286), thence South 29°00'00" West, along said centerline, 660.00 feet, more or less. THENCE South 61°30'00" East 460.00 feet, more or less, for the East corner of this tract; THENCE South 46°22'43" West 162.87 feet, more or less, for the South corner of this tract; THENCE North 61°30'00" West 410.00 feet, more or less, for the West corner of this tract; THENCE North 28°30'00" East 155.00 feet, more or less, for the POINT OF BEGINNING. Tract 4 FIELDNOTES for 17.3 acres, more or less, of land out of Lot 7, Section 8, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at the West corner of this tract from which corner a point in the centerline of Ayers Street (State Highway 286) for the West corner of said Lot 7, Section 8 bears South 29°00'00" West 160.00 feet, more or less, thence North 61°30'00" West 940.00 feet, more or less; THENCE North 29°00'00" East 500.00 feet, more or less, for the North corner of this tract; THENCE South 61°30'00" East 1507.50 feet, more or less, to a point on the Northwest boundary of a City of Corpus Christi drainage right-of-way (Richter Ditch) for the East corner of this tract; THENCE South 29°00'00" West, along the Northwest boundary of said drainage right-of-way, 500.00 feet, more or less, for the South corner of this tract; THENCE, leaving said Northwest boundary, North 61°30'00" West 1507.50 feet, more or less, for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of �Y%aq , 19 fat/ .
