HomeMy WebLinkAbout18229 ORD - 05/16/1984AN ORDINANCE AUTHORIZING THE EXECUTION OF A REMOVAL OF COVENANTS DOCUMENT FOR RELEASING LOTS 1, 2, 38, AND 39, BLOCK 5, AND THE AREA DESIGNATED "WATER ACCESS AREA" PADRE ISLAND CORPUS CHRISTI BARATERIA BAY UNIT #2 FROM ANY FUTURE PARK USE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a removal of covenants document for releasing Lots 1, 2, 38, and 39, Block 5, and the area designated "Water Access Area", Padre Island Corpus Christi Barateria Bay Unit #2 from any future park use. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 16th day of May, 1984. BRUCE AYCOCK, CITY ATTORNEY — By ,Cr"'� // =//./ Assistant Ci�ltorney 18229 THE CITY O CORPUS CHRISTI, TEXAS MICROFILMED SEP 2 81984 REMOVAL OF COVENANTS THE STATE OF TEXAS 4 COUNTY OF NUECES 4 WHEREAS, by deed dated March 6, 1969 and recorded in Volume 1317, Page 68 of the Deed Records of Nueces County, Texas (the "Deed") Padre Island Investment Corporation conveyed to Padre Island Investment Corporation, Trustee, the sur- face estate in and to the following described property located in Nueces County, Texas: Lots I, 2, 38 and 39, Block 5 and the tract designated as "Water Access Area" on the map or plat of Padre Island - Corpus Christi, Barataria Bay Unit 2, a subdivision of Nueces County, Texas, as shown by the map or plat thereof recorded in Volume 34, Pages 62 and 63, Map Records of Nueces County, Texas; WHEREAS, the Deed imposed certain covenants on the above described property which were to run with the land; WHEREAS, all of those holding any record interest in the above described property desire to have such covenants removed from a portion of such property; NOW, THEREFORE, for good and valuable consideration, the receipt and suffi- ciency of which are hereby acknowledged, the undersigned agree that all of the covenants imposed by the Deed shall hereafter have no force or effect on the following described property, and the undersigned waive any rights they or their successors, heirs or ssigns may have hereafter to enforce such covenants imposed in the Deed upon the following described property: Lots 1, 2, 38, and 39, Block 5, Padre Island - Corpus Christi, Barataria Bay Unit 2, a subdivision of Nueces County, Texas, as shown by the map or plat thereof recorded in Volume 34, Pages 62 and 63, Map Records of Nueces County, Texas; FURTHER, this instrument shall not affect the imposition of the covenants in the Deed against the remainder of the property described in the Deed being: The tract described as the "Water Access Area" on the map or plat of Padre Island - Corpus Christi, Barataria Bay Unit 2, a subdivision of Nueces County, Texas, as shown by the map or plat thereof recorded in Volume 34, Pages 62 and 63, Map Records of Nueces County, Texas.
