HomeMy WebLinkAbout18236 ORD - 05/16/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF WILLIAM P. TIPTON, D.D.S. BY CHANGING THE ZONING MAP IN REFERENCE TO LOTS 6 AND 7, AND A PORTION OUT OF LOTS 5 AND 8, BLOCK 1, ROPER SUBDIVISION FROM "AB" PROFESSIONAL OFFICE DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of William P. Tipton, D.D.S. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 16, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lots 6 and 7, and a portion of Lots 5 and 8, Block 1, Roper Subdivision, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "AB" Professional Office District to "B-1" Neighborhood Business District: DESCRIPTION of a portion of Lot 8, Block 1, Roper Subdivision, as shown by map recorded in Volume 13, Page 37, Map Records, Nueces County, Texas, being described as follows: BEGINNING at the common southwest corner of said Lot 8 and the northwest corner of Lot 7, Block 1, Roper Subdivision, said corners being in the east right-of-way of Everhart Road; THENCE, along said east right-of-way, N 28°59'20" E, 16.67 feet; THENCE, S 61°00'40" E, 164.98 feet to the east boundary line of said Lot 8; 18236 MICROFILMED sE? 2 81984 THENCE, along said east line, S 28°59'20" W, 16.67 feet to the southeast corner of said Lot 8; THENCE, along the common line between Lots 7 and 8, N 61°00'40" W, 164.98 feet to the POINT OF BEGINNING. CONTAINING 2,750.00 square feet, more or less. DESCRIPTION of a portion of Lot 5, Block 1, Roper Subdivision, as shown by map recorded in Volume 13, Page 37, Map Records, Nueces County, Texas, being described as follows: BEGINNING at the common northwest corner of said Lot 5 and the southwest corner of Lot 6, Block 1, Roper Subdivision, said corners being in the east right-of-way of Everhart Road; THENCE, along the common line between said Lots 5 and 6, S 61°00'40" E, 164.98 feet to the northeast corner of Lot 5; THENCE, along the east line of Lot 5, S 28°59'20" W, 16.67 feet; THENCE, N 61000'40" W, 164.98 feet to the east right-of-way of Everhart Road; THENCE, along said east right-of-way, N 28°59'20" E, 16.67 feet to the POINT OF BEGINNING. CONTAINING 2,750.22 square feet, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or } resolutions at three regular meetings so that this ordinance is pass dynd shall take effert upon first:r:lading as an emergency measure this the Ib day of , 19 j' ATTEST: C1'ty Secretary / rv�a APPROVED:f DAY OF , 1984 J.
