HomeMy WebLinkAbout18258 ORD - 05/30/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF SPOHN HOSPITAL BY GRANTING A SPECIAL COUNCIL PERMIT ON A PORTION OF LOT 25, BLOCK 6, DEL MAR SUBDIVISION, FOR THE USE OF A PORTION OF LOT 25 FOR PARKING, WITH A 25 YEAR RESTRICTION ON EXPANSION OF THE PARKING LOT ON LOTS 1, 2, 23 and 24, DEL MAR SUBDIVISION, AND SOUTH OF COLE STREET IN THE DEL MAR SUBDIVISION, FROM THE DATE OF ADOPTION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Spohn Hospital for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 2, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for the use of a portion of Lot 25, Block 6, Del Mar Subdivision, for the use of a portion of Lot 25 for parking, as described by metes and bounds below, with a 25 year restriction on expansion of the parking lot on Lots 1, 2, 23, and 24, Del Mar Subdivision, and south of Cole Street in the,Del Mar Subdivision, from the date of adoption of this ordinance, situated in the City of Corpus Christi, Nueces County, Texas, as shown in the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", subject to all other considerations of "AB" Professional Office District. Being a tract of land out of Lot 25, Block 6, Del Mar Subdivision, an addition to the City of Corpus Christi, Nueces County, Texas, as shown on the map thereof recorded in Volume 48 at Page 123 of the Map Records of Nueces County, Texas, and being more particularly described by metes as bounds as follows: 18258 MtCRufILMED SEP 2 81984 tract of land embracing 11,578.31 square feet or 0.2658 BEGINNING at a point lying in the east right-of-way line of Third Street, said point being the southernmost corner of Lot 25, the northwest corner of Lot 23, Block 6, Del Mar Subdivision, and the southwest corner of this tract; THENCE N 31°06'09" W along the east right-of-way line of Third Street and the west line of Lot 25, Block 6, Del Mar Subdivision, a distance of 100.00 feet to a point for the northwest corner of this tract; THENCE N 58°53'45" E a distance of 118.84 feet to a point, said point lying in the east line of Lot 25 and the west line of Lot 4, Block 6, Del Mar Subdivision, for the northeast corner of this tract; THENCE S 26°25'59" E along the east line of Lot 25 and the west line of Lot 4, Block 6, Del Mar Subdivision, a distance of 50.17 feet to a point, said point being the southwest corner of Lot 4 and the northwest corner of Lot 3, Block 6, Del Mar Subdivision; THENCE S 31°06'09" E continuing along the east line of Lot 25 and the west line of Lot 3, Block 6, Del Mar Subdivision, a distance of 50.00 feet to a point for the southeast corner of this tract, said point being the southeast corner of the most southerly portion of Lot 25, the southwest corner of Lot 3 and the northwest corner of Lot 2, Block 6, Del Mar Subdivision; THENCE S 58°53'51" W along the south line of Lot 25 and the north line of Lot 23, Block 6, Del Mar Subdivision, a distance of 114.76 feet to the point of beginning forming a tract of land embracing 11,578.31 square feet or 0.2658 acres. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon 19rst,reading as an emergency measure this the �j4 , day ATTEST: tt�� City ecretary yOr MAYOR APPROVyFF��O -ta DAY OF 19 : ../g; J.
