HomeMy WebLinkAbout18283 ORD - 06/12/1984AN ORDINANCE CLOSING AND ABANDONING THAT 40 FOOT WIDE SECTION OF OF EVERHART ROAD DESCRIBED BY ATTACHED MAP AND METES AND BOUNDS; AND PROVIDING FOR THE REPLAT OF SAID PROPERTY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of that 40 foot wide section of Everhart Road, as shown by attached Map and metes and bounds, marked Exhibits "A" and "B", was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on May 30, 1984, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of right-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights of way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. BOX 6355, 2725 SWANTNER CORPUS CHRISTI, TEXAS 78411 PHONE 854-3101 March 29, 1984 STATE OF TEXAS COUNTY OF NUECES Job No. 19780.42 FIELDNOTES for the abandonment of a portion of a 40.00 foot wide right-of-way (Everhart Road) out of Lot 3, Section 19, Bohemian Colony Lands, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas and out of Lots 17 and 31, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43 of said Map Records: BEGINNING at a point on the Northwest boundary line of said 40.00 foot wide right-of-way (Everhart Road) for the North corner of this tract from which corner the centerline intersection of Everhart Road and Yorktown Boulevard as shown on the recorded plat of The Lakes Unit 1, a map of which is recorded in Volume 49, Pages 52 thru 54 of said Map Records bears North 30°04'33" East 1120.18 feet, said North corner also being the point of curvature of a circular curve to the left whose radius point bears North 86°53'33" East 378.00 feet and which has a central angle of 10°02'42", a radius of 378.00 feet, a tangent distance of 33.22 feet and an arc length of 66.27 feet; THENCE, leaving said Northwest boundary line, along said circular curve to the left, 66.27 feet to a point on the Southeast boundary line of said 40.00 foot wide right -of --way for the East corner of this tract; THENCE South 29°03'10" West, along said Southeast boundary line, parallel to the centerline thereof and 20.00 feet distant therefrom, measured at right angles thereto, said centerline being the common boundary line between said Bohemian Colony Lands and said Flour Bluff and Encinal Farm and Garden Tracts, a distance of 146.26 feet for the South corner of this tract; THENCE, leaving said Southeast boundary line, South 63°25'05" West 70.86 feet to a point on the aforementioned Northwest boundary line of said 40:00 foot wide right-of-way for the West corner of this tract; THENCE North 29°03'10" East, along said Northwest boundary line, parallel to the aforementioned centerline thereof and 20.00 feet distant therefrom, measured at r"zaht angles thereto, 257.48 feet for the POINT o_' BEGINNING and containing 6,011 square feet of land.
