HomeMy WebLinkAbout18299 ORD - 06/19/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF MR. AND MRS. TOM B. GUNTER BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF TRACT I, CALALLEN ANNEX, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Mr. and Mrs. Tom B. Gunter for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, June 19, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion out of Tract I, Calallen Annex, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "6-4" General Business District: Being 4.02 acres, more or less, out of the northerly portion of Tract I, Calallen Annex, map of which is recorded in Volume 42, Page 84, of the Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows, to -wit: BEGINNING at a 5/8 inch iron rod marking the NE corner of said Tract I, Calallen Annex, for the NE corner of this tract and the point of beginning, also being an inside corner of the Ben Vaughn tract; THENCE S 08°53' W, along the common line between said Tract I, Calallen Annex and the Ben Vaughn tract, a distance of 633.17 feet to a point in the proposed right-of-way line of Interstate Highway No. 37 for the SE corner of this tract, also being the SW corner of the remaining portion of said Ben Vaughn tract; 18299 MICROFILMED SEP 2 S 1984 THENCE, in a northwesterly direction, along a curve to the right whose radius is 2251.83 feet and along the northerly boundary line of the right-of-way of said Interstate Highway No. 37, as widened, a distance of 477.47 feet to its intersection with the westerly boundary line of said Tract I, Calallen Annex, and the easterly boundary line of Lot 3, J. E. Wilson Subdivision, map of which is recorded in Volume 19, Page 23, of the Map Records of Nueces County, Texas, for the SW corner of this tract; THENCE N 08°53' E, along the westerly boundary line of said Tract I, Calallen Annex and along the easterly boundary line of said J. E. Wilson Subdivision, Lot 3, and along the easterly boundary line of Calallen Annex, Tract B, as shown on map of record in Volume 29, Page 52, of the Map Records of Nueces County, Texas, a distance of 320.88 feet to the NW corner of said Tract I, Calallen Annex, for the NW corner of this tract, also being a southwesterly corner of said Ben Vaughn tract; THENCE S 81°07' E, along the common line between said Tract I, Calallen Annex and said Ben Vaughn tract, a distance of 360.0 feet to the point of beginning and containing 4.02 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspen ion of the Charter rule as to consideration and voting upon ordinances or resol ons at three regular meetings so that this ordinance is pas edj�nd shall take fect upon first dr ding as an emergency measure this the II day of .1.--, 19 ATT iit y�Se ry ��1� MAYOR rro• THE CITY OF CORPUS CHRISTI, TEXAS APPROVED:AYCM DAY OF JUNE, 1984 J.
