HomeMy WebLinkAbout18332 ORD - 07/10/1984AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF CORPUS CHRISTI, TEXAS JOINTLY WITH THE COUNTY OF NUECES, TEXAS, ON THE 11TH DAY OF AUGUST, 1984, UPON THE QUESTION OF ADOPTING AMENDMENTS TO THE CITY CHARTER OF THE CITY OF CORPUS CHRISTI; PROVIDING FOR PLACES WHERE SUCH ELECTION SHALL BE HELD; PROVIDING FOR THE HOLDING OF SUCH ELECTION; SETTING FORTH PROPOSITIONS TO BE VOTED ON AT SAID ELECTION; PROVIDING FOR NOTICE OF SUCH ELECTION; PROVIDING SEVERABILITY AND DECLARING AN EMERGENCY. WHEREAS, the City Council finds that two petitions for Charter amendments filed with the City Secretary on June 22, 1984 have been certified by the City Secretary on July 10, 1984 as containing a sufficient number of signatures a prescribed by law and that such proposed Charter amendments should be included on the ballot for the election of August 11, 1984 as Propositions One, Two and Three; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. An election is hereby ordered to be held on Saturday the llth day of August, 1984 in the City of Corpus Christi, Texas, jointly with the County of Nueces, Texas, at which election there shall be submitted to the voters who are qualified to vote under the Constitution and laws of the State of Texas, the following proposed amendments to the City Charter of the City of Corpus Christi, Texas: PROPOSITION ONE Shall Article VIII, Section 2(d) of the City Charter be repealed in its entirety? PROPOSITION TWO Shall Article VIII, Section 3(a) of the City Charter, as amended April 5, 1980 be repealed in its entirety and be replaced by the following Amendment 3(a)? (a) Every ordinance granting, renewing, extending or amending a public utility franchise or a lease of property of the city shall be read at three (3) regular meetings of the council, and shall not be finally acted upon until thirty (30) days after the first reading thereof. Within five (5) days following each of the three (3) readings of the ordinance, the full text thereof shall be published one time in some newspaper of general circulation in the city, and the expense of such Amended by OrdinanceNO./JAW Hata .7/y 18332 UFILMED SEP 1984 publication shall be borne by the prospective franchise holder or lessee. No such ordinance shall become effective until the expiration of sixty (60) days following the date of its final adoption by the council, and every such ordinance, franchise or lease shall be subject to the referendum procedure provided by state law, Article 1181, Vernon's Texas Civil Statutes, as amended now or in the future. PROPOSITION THREE Shall Article IV, Section 16 of the Home Rule Charter of the City of Corpus Christi, Texas be amended so henceforth Section 16 shall read as follows? Section 16. Interdepartmental transfer of funds. Upon the written recommendation of the City Manager, the City Council may at any time transfer the unencumbered balance of an appropriation made for the use of one department, division or purpose, to any other department, division or purpose; provided however that from and after August 15, 1984, no such transfer shall be made of revenues or earnings of any municipally owned utility, such as the water, gas or sewerage department, to any other department or to any other purpose, with the exception of any utility required debt service. SECTION 2. The ballots for said election shall be in such form as those voters intending to vote "yes" shall show on their ballot a vote "For" the respective proposition, and those intending to vote "No" shall show on their ballot a vote "Against." SECTION 3. The election shall be held pursuant to Article 1170, R.C.S., Texas, and the general laws of Texas pertaining to elections insofar as such are applicable hereto. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the date of said election, and voting machines shall be employed at the election herein ordered pursuant to the Texas Election Code, V.T.S., Article 7.14, as amended. SECTION 4. This election shall be held jointly with an election of the County of Nueces, Texas; the expenses of such election shall be borne by the City of Corpus Christi and by the County of Nueces on a fifty-fifty basis; a single ballot form containing each proposition to be voted on shall be used at each joint polling place, the poll lists, tally sheets and returns forms for such elections may be combined and multiple sets of the joint returns of such election may be made by the election officials holding such elections; one set of all returns and tally lists shall be delivered to the City Council of the City of Corpus Christi; and one set of such returns and tally lists shall be delivered to the County of Nueces; and only one set of election precincts, voting places and election officials (hereinafter designated) shall be used in the conduct of such joint election. SECTION 5. County Clerk, Marion Uehlinger is hereby appointed Election Manager and Judge of said election, and she is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State, and City Secretary Bill G. Read, is instructed to assist in holding such election in accordance with the laws of this State. SECTION 6. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted at the first floor of the Nueces County Courthouse, from 8:00 a.m. to 5:00 p.m., Monday through Friday, beginning on July 23, 1984 and ending August 7, 1984. The following official shall conduct the absentee voting: County Clerk, Marion Uehlinger. SECTION 7. A special canvassing board shall be used to count the absentee ballots, and the following persons are hereby appointed to serve as such special canvassing board, to -wit: John Welsh, Frank Medina and Herlinda Medina. SECTION 8. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 9. County election precincts and County election judges will be utilized. SECTION 10. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 11. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 12. The necessity to submit to the qualified voters the hereinabove set forth amendments to the City Charter creates a public' emergency and an imperative public necessity requiring the suspension of the Charter Rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter Rule that this ordinance be passed finally on the date of its introduction and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /O day of July, 1984.
