AMENDING ORDINANCE NO. 18332 TO RESTATE THE WORDING OF THE
PROPOSED CHARTER AMENDMENT PROPOSITIONS; AND DECLARING AN
EMERGENCY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 1 of Ordinance No. 18332 ordering a Charter
amendment election to be held on August 11, 1984, and setting forth the wording
of three proposed Charter amendment propositions be amended so that the wording
of the three propositions are as follows:

PROPOSITION 1
Repealing Article VIII, Section 2(d), of the City Charter in its
PROPOSITION 2
Repealing Article VIII, Section 3(a), of the City Charter, as amended
April 5, 1980, in its entirety and replacing it with the following amendment
3(a):
Every ordinance granting, renewing, extending, or amending a
public utility franchise or a lease of property of the city
shall be read at three (3) regular meetings of the council,
and shall not be finally acted upon until thirty (30) days
after the first reading thereof. Within five (5) days
following each of the three (3) readings of the ordinance,
the full text thereof shall be published one time in some
newspaper of general circulation in the city, and the
expense of such publication shall be borne by the
prospective franchise holder or lessee. No such ordinance
shall become effective until the expiration of sixty (60)
days following the date of its final adoption by the
council, and every such ordinance, franchise, or lease shall
be subject to the referendum procedure provided by State
law, Article 1181, Vernon's Texas Civil Statutes, as amended
now or in the future.
PROPOSITION 3
Amending Article IV, Section 16, of the Home Rule Charter of the City
of Corpus Christi, Texas, so henceforth Section 16 shall read as follows:

Section 16. Inter -departmental transfer of funds.
Upon the written recommendation of the City Manager, the
City Council may at any time transfer the unencumbered
balance of an appropriation made for the use of one
department, division or purpose, to any other department,
division or purpose; provided, however, from and after
August 15, 1984, no such transfer shall be made of revenues
or earnings of any municipally owned utility, such as the
water, gas or sewerage department, to any other department
or to any other purpose, with the exception of any utility
required debt service.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by amending the aforementioned
ordinance ordering a Charter amendment election to be held so as to restate the
wording of the propositions, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this the
17th day of July, 1984.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
