HomeMy WebLinkAbout18344 ORD - 07/17/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CLIFF ZARSKY TEXAN HOMES, INC. BY GRANTING A SPECIAL COUNCIL PERMIT ON A PORTION OUT OF LOTS 5 AND 6, SECTION 50, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FOR A TOWNHOUSE DEVELOPMENT WITH A MAXIMUM OF 19 TOWNHOUSE UNITS PER ACRE; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Cliff Zarsky Texas Homes, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, May 23, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion out of Lots 5 and 6, Section 50, Flour Bluff. and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, and more fully described by metes and bounds below, for a townhouse development with a maximum of 19 townhouse units per acre, as shown in the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", subject to all other considerations of "A-1" Apartment House District; provided, that said Special Permit shall be in force for a term of two (2) years from date hereof. FIELDNOTES for 9.20 acres of land out of Lots 5 and 6, Section 50, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of Glenoak Drive (60.00 feet wide) from which point the centerline intersection of Glenoak Drive and St. Joseph Street (60.00 feet wide) bears North 29°00'00" East 30.00 feet, thence North 61°00'00" West 40.00 feet; 18344 1 MICRUEILMED SEP 81984 THENCE South 61°00'00" East, along said Southwest boundary line of Glenoak Drive, parallel to the centerline thereof and 30.00 feet distant therefrom, measured at right angles thereto, 460.04 feet for the East corner of this tract; THENCE, leaving said Southwest boundary line, South 29°00'00" West, along the Northwest boundary line of a 90.00 foot wide City of Corpus Christi drainage right-of-way, 30.00 feet for the point of curvature of a circular curve to the left whose radius point bears South 61°00'00" East 298.34 feet and which has a central angle of 72°26'12", a radius of 298.34 feet, a tangent distance of 218.50 feet and an arc length of 377.18 feet; THENCE, along said boundary of said drainage right-of-way, with said circular curve to the left, 377.18 feet for the point of tangency and for the point of curvature of a circular curve to the right whose radius point bears South 46°33'48" West 208.34 feet and which has a central angle of 72°26'12", a radius of 208.34 feet, a tangent distance of 152.58 feet and an arc length of 263.40 feet; THENCE, continuing along the Northwest boundary of said drainage right-of-way, with said circular curve to the right, 263.40 feet for the point of tangency, for a corner of said drainage right-of-way and for an inside corner of this tract; THENCE South 61°00'00" East 10.00 feet for an inside corner of said drainage right-of-way and for a corner of this tract; THENCE South 29°00'00" West, along the Northwest boundary of an 80.00 foot wide City of Corpus Christi drainage right-of-way, 776.94 feet for the South corner of this tract; THENCE, leaving the Northwest boundary of said drainage right-of-way, North 61°00'00" West 190.31 feet for the lower West corner of this tract; THENCE North 29°00'00" East 645.00 feet for the point of curvature of a circular curve to the left whose radius point bears North 61°00'00" West 145.10 feet and which has a central angle of 44°55'56", a radius of 145.10 feet, a tangent distance of 60.00 feet and an arc length of 113.79 feet; THENCE, with said circular curve to the left, 113.79 feet for the point of tangency; THENCE, North 15°55'56" West 175.63 feet for the point of curvature of a circular curve to the left whose radius point bears South 74°04'04" West 144.61 feet and which has a central angle of 45°04'04", a radius of 144.61 feet, a tangent distance of 60.00 feet and an arc length of 113.75 feet; THENCE, with said circular curve to the left, 113.75 feet for the point of tangency; THENCE, North 61°00'00" West 355.09 feet for the upper West corner of this tract; THENCE, North 14°21'09" East 31.01 feet for an inside corner of this tract and the point of curvature of a circular curve to the right whose radius point bears North 29°00'00" East 10.00 feet and which has a central angle of 85°32'26", a radius of 10.00 feet, a tangent distance of 9.25 feet and an arc length of 14.93 feet; THENCE, with said circular curve to the right, 14.93 feet to a point on the Southeast boundary line of St. Joseph Street for the point of tangency and for the point of curvature of a circular curve to the right whose radius point bears South 65°27'34" East 362.97 feet and which has a central angle of 04°27'34", a radius of 362.97, a tangent distance of 14.13 feet and an arc length of 28.25 feet; THENCE, with said circular curve to the right, along the Southeast boundary line of St. Joseph Street, 28.25 feet for the point of tangency; THENCE, North 29°00'00" East, along said Southeast boundary line of St. Joseph Street, 297.56 feet for the point of curvature of a circular curve to the right which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE, with said circular curve to the right, 15.71 feet for the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 17th day of July, 1984.
