HomeMy WebLinkAbout18353 ORD - 07/24/1984AN"ORDINANCE AMENDING SECTIONS 21-7, 21-18 THROUGH 21-21.1, AND 21-46 OF THE CODE OF ORDINANCES SO AS TO INCREASE GARBAGE COLLECTION AND DISPOSAL CHARGES APPROXIMATELY FIVE PERCENT (5%) EFFECTIVE WITH THE FIRST BILLING CYCLE IN THE MONTH OF AUGUST, 1984; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 21-7 of the Code of Ordinances, City of Corpus Christi, 1976, as amended, is hereby amended to hereafter read as follows: "Section 21-7. Tree Limbs, Grass Clippings, etc. Tree limbs, grass clippings and other trash will be collected on a regularly scheduled basis only if properly prepared by being cut in lengths not exceeding five (5) feet, and bundled or placed in suitable containers weighing not more than fifty (50) pounds, and if in the opinion of the superintendent, it will not cause damage to the garbage collection equipment. Other trash will be collected from collection service customers from time to time, up to one truck load, and a fee of twenty-three dollars ($23.00) shall be charged for each additional load after the first load." SECTION 2. That Sections 21-18 through 21-21.1 of the Code of Ordinances, City of Corpus Christi, 1976, as amended, are hereby amended to hereafter read as follows: "Section 21-18. Same - To Business and Commercial Establishments, etc. (a) The business and commercial institutions and all other occupied premises in the City of Corpus Christi for which the collection service of the Sanitation Division is available, except residences covered by Section 21-18 of this code, shall be charged at a minimum rate of thirteen dollars and seventy cents ($13.70) for two (2) days per week pick-up, or twenty-seven dollars and forty cents ($27.40) per month for four (4) days per week pick-up in the areas designated for such service. All charges above the minimum rates shall be determined by the superintendent; shall be reasonable; shall be determined by the type and amount of refuse, the location of the refuse and the number of pick-ups per week that are necessary to properly service and maintain sanitary conditions; and shall be not less than an amount proportional to the minimum charges provided in this article, said minimum charges being based on collection of one cubic yard of garbage per week. (b) All other business and commercial institutions and other occupied premises, except residences, shall be charged for the disposal services of the Sanitation Division at a minimum rate of two dollars and thirty-three cents ($2.33) per month for the first cubic yard or fraction thereof of trash and garbage per week, and an additional two dollar and thirty-three cents ($2.33) per month for each additional cubic yard or fraction thereof per week, based on the superintendent's estimate of volume of garbage and trash." "Section 21-20. Same - For Garbage and Trash from Outside the City. Charges for the disposal services of the Sanitation Division for garbage and trash from outside the City shall be as follows: (1) Residential: Two dollars and fifty-seven cents ($2.57) per month per dwelling unit. (2) Other: Three dollars and ninety cents ($3.90) per month for the first cubic yard or fraction thereof per week, and an additional three dollars and ninety cents ($3.90) per month for each additional cubic yard or fraction thereof per week, based on the superintendent's estimate of the volume of garbage and trash." "Section 21-21. Same - For Large Dead Animals. A direct charge of twenty-three ($23.00) shall be made at the time the service is required for the collection of any large dead animal." "Section 21-21.1. Same - For Demolition Debris. The charge for disposal services of the Sanitation Division for debris from demolition of buildings and structures shall be assessed on a project basis at the rate of sixty cents ($0.60) per cubic yard, based on the volume estimated by the superintendent." SECTION 3. That Section 21-46 of the Code of Ordinances, City of Corpus Christi, 1976, as amended, is hereby amended to hereafter read as follows: "Section 21-46. Fees for Solid Waste Permits. (a) The fee for a solid waste permit shall be seventy dollars ($70.00) per vehicle, payable to the City at the time of issuance of the solid waste permit, except as provided herein. (b) The fee for a solid waste permit shall be one hundred forty dollars ($140.00), payable to the City at the time of issuance of the solid waste permit, for any vehicle which is to be used to convey or transport garbage or trash from outside the City to any disposal site of the City Sanitation Division." SECTION 4. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 6. The rates established by this ordinance shall be applied against all garbage collection and disposal services beginning with Cycle 1 on or around August 1, 1984, and which shall be billed to customers beginning with Cycle 1 on or around September 1, 1984. SECTION 7. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance stating in substance the purpose of the ordinance.
