HomeMy WebLinkAbout18359 ORD - 07/24/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.70, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS "'A' PORTION OUT OF LOTS 31 AND 32, SECTION 27, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. Y WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Lake Placid Estates, Inc. for amendment to the zoning:map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, July 24, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "R-2" on a portion out of Lots 31 and 32, Section 27, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of -the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: "SECTION 1. That the Zoning Ordinance of the City of Corpus Christi; Texas, is amended by making the change hereinafter set out. SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.70 to hereafter read as follows, such zoning classification of the hereinafter described properties to be effective upon annexation: 18359 MICROFILMED SEP 28 1984 41, "Section 31-5.70. The following described tracts of land shall be zoned and classified as follows: "R-2" Multiple Dwelling District on the following more particularly described tract: Description of 1.63 acres of land, more or less, out of Lots 31 and 32, Section 27, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43 of the Map Records of Nueces County, Texas, said 1.63 acre tract of land is further described by metes and bounds as follows: BEGINNING at a 5/8" iron rod found at the southernmost corner of said Lot 31 for the southernmost corner of this tract; THENCE along the southwest boundary line of said Lots 31 and 32 N 61°02'35" W 1160.00 feet, more or less, to a point on the present east right-of-way line of Rodd Field Road for the southwest corner of this tract; THENCE in a northwesterly direction, along said right-of-way line, a distance of 70.00 feet, more or less, to a point on the present city limit line for the northeast corner of this tract; THENCE S 61°02'35" E 1200.00 feet, more or less, along the present city limit line, to a 5/8" iron rod set in the southeast boundary line of said Lot 31 for the easternmost corner of this tract; THENCE S 28°59'10" W 60.00 feet along said southeast boundary line of Lot 31 to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take ffect upon fir t reading as an emergency measure this the2 Y''4 day of , 19 ATTEST: �� ��CITY d City Secretary MAYOR TH OF CORPUS CHRISTI, TEXAS APPROVED: 73,,,04 DAY OF L< f, , 19 8e1 : J.
