HomeMy WebLinkAbout18380 ORD - 07/31/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF GULF COAST COUNCIL OF LA RAZA BY CHANGING THE ZONING MAP IN REFERENCE TO LOTS 9 AND 10, AND A PORTION OUT OF LOT 11, ELLENDALE GARDENS NO. 2, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Gulf Coast Council of La Raza for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, July 31, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lots 9 and 10, and a portion out of Lot 11, Ellendale Gardens No. 2, as described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District to "B-4" General Business District: Description for the Southwest 5.00 feet of Lot 11, Ellendale Gardens No. 2, a subdivision of the City of Corpus Christi, Texas, and recorded in Volume 5, Page 2, Map Records, Nueces County, Texas, said Southwest 5.00 foot strip of land being more particularly described by metes and bounds as follows: Thence North 52°37" West, with the southwest line of said Lot 11, the northeast line of said Lot 10, a distance of 354.78 feet to a 3/4 inch iron pipe in the most westerly corner of said Lot 11, the most northerly corner of said Lot 10, for the most westerly corner of the tract herein described; Thence North 18°51'20" East, with the northwest line of said Lot 11, a distance of 5.27 feet to a 3/4 inch iron pipe for the most northerly corner of the tract herein described; 18350 SEP 2 81984 MICROFILMED a Thence South 52°37" East, with a line that is 5.0 feet northeast of and parallel to the southwest line of said Lot 11, and generally with a 5 foot high hurricane -type fence, a distance of 355.38 feet to a 3/4 inch iron pipe in the northwest right of way line of said Omaha Drive, for the most easterly corner of the tract herein described; Thence South 25°12" West, with the northwest right of way line of said Omaha Drive, the southeast line of said Lot 11, a distance of 5.12 feet to the point of beginning. Containing 1775.4 square feet of land more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 31st day of July, 1984.
