CLOSING AND ABANDONING A PORTION OF A 7.5 FOOT WIDE UTILITY
EASEMENT OUT OF LOT 21, BLOCK 103, HUNTERS POINT UNIT 2,
SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN
EMERGENCY.
WHEREAS, there exists a portion of a 7.5 foot wide utility easement
out of Lot 21, Block 103, Hunters Point Unit 2, as recorded in Volume 49,
Pages 16 and 17, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That a portion of a 7.5 foot wide utility easement out of
Lot 21, Block 103, Hunters Point Unit 2, as recorded in Volume 49, Pages 16 and
17, Map Records of Nueces County, Texas, and as described by metes and bounds, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A", be and the same is hereby closed for public use and every municipal
purpose, provided that a portion of Southwestern Bell Telephone Company cable
within the portion of easement to be closed is relocated and said Lot 21 is
replatted, all at applicant's expense. The above described utility easement is
hereby abandoned to the owners of the abutting property in accordance with the
laws of the State of Texas, and for the service and interest of the inhabitants
of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility easement at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the 21st day of
August, 1984.

FIELDNOTES for the abandonment of a portion of a 7.50 foot wide utilityeasemer
out of Lot 21, Block 103, Hunter's Point Unit 2, a map of which is recorded in
Volume 40, Pages 16 and 17, Map Records of Nueces County, Texas:
BEGINNING at the West corner of said portion of the utility easement to
be abandoned from which corner a 5/8 inch iron rod found for the West corner of
said Lot 21 bears North 57°44'22" West 18.9 feet;
THENCE North 42°13'06" East I.4 feet to a point on the Northeast boundary
line of the existing 7.50 foot wide utility easement for the North corner of said
portion of the utility easement to be abandoned and for the point of curvature of
a circular curve to the left whose radius point bears North 47°57'42"_East 158.30
feet and which has a central angle of 04°16'49", a radius of 158.30 feet, a tangent
distance of 5.92 feet and an arc length of 11.83 feet;
THENCE, with said circular curve to the left, along said Northeast boundary
line of the existing 7.50 foot wide utility easement, 11.83 feet to the ending r-'''--
of this curve and the East corner of said portion of the easement to be abandoned;
THENCE, leaving the Northeast boundary line of said existing utility easement,
South 42°23'06" West 0.7 feet for the South corner of said portion of the easement
to be adandoned;
THENCE North 47°46'54" West 11.8 feet to the POINT OF BEGINNING and
containing 11.77 square feet of land.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
