CLOSING AND ABANDONING THE SOUTH 20 FEET OF A 40 FOOT WIDE
ROAD IN LOTS 12, 13, 20, 21, 28, 29, 36, 37, 44, AND 45,
ARTEMUS ROBERTS SUBDIVISION; RETAINING A UTILITY EASEMENT
AND PROVIDING FOR THE REPLAT OF SAID PROPERTY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of the south 20 feet of a 40 foot wide road in Lots 12, 13, 20, 21,
28, 29, 36, 37, 44, and 45, Artemus Roberts Subdivision, as shown by plat in
Volume 3, Page 41, Map Records, Nueces County, Texas, was given by publication
and mailed to the last known addresses of the owners of property abutting the
public way and within 450 feet of the area proposed to be closed, and
thereafter, pursuant to said notice, public hearing was held at Regular Council
Meeting by the City Council of the City of Corpus Christi on August 7, 1984, in
accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights of way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned the south 20
feet of a 40 foot wide road in Lots 12, 13, 20, 21, 28, 29, 36, 37, 44, and 45,
Artemus Roberts Subdivision, as shown by plat in Volume 3, Page 41, Map Records,
Nueces County, Texas, and by the metes and bounds which are attached hereto and
made a part hereof, marked Exhibit "A", providing for replatting at applicants
expense, and retaining a 10 foot wide utility easement along the north side of
said 20 foot street.

FIELDNOTES for the closing of a 20.00 foot wide road easement out of
Lots 12, 13, 20, 21, 28, 29, 36, 37, 44 and 45, Artemus R. Roberts Subdivision,
a map of which is recorded in Volume 3, Page 41, Map Records of Nueces County,
Texas:
BEGINNING at a point on the North boundary line of said Lot 45 for the
Northwest corner of this easement from which corner a 5/8 inch iron rod
found at the centerline intersection of Haven Road and McKinzie Road for the
Northwest corner of said Lot 45 bears North 89°54'30" West 20.00 feet;
THENCE South 89°54'30" East, along the North boundary line of said
Artemus R. Roberts Subdivision, at 567.98 feet pass the Southwest subdivision
corner of Highway Village Section 3, a map of which is recorded in Volume 13,
Page 24 of said Map Records,at 2626.18 feet pass the Southeast subdivision
corner of said Highway Village Section 3 and the Southwest subdivision corner
of Rolling Acres Subdivision, a map of which is recorded in Volume 10, Page 57
of said Map Records, in all a distance of 6060.33 feet to a point on the
West boundary line of Leopard Street (State Highway No. 9) for the Southeast
subdivision corner of said Rolling Acres Subdivision and for the Northeast
corner of this easement;
THENCE South 65°04'20" East, along said West boundary line of Leopard
Street, 47.62 feet for the Southeast corner of this easement;
THENCE, leaving said West boundary line of Leopard Street, North 89°54'30"
West 6103.58 feet for the Southwest corner of this easement;
THENCE North 00°11'20" East, parallel to the centerline of McKinzie Road
thereof and 20.00 feet distant therefrom, measured at right angles thereto,
20.00 feet for the POINT OF BEGINNING.
