HomeMy WebLinkAbout18427 ORD - 08/21/1984AN ORDINANCE AMENDING CHAPTER 55, ARTICLE XII, WATER CONSERVATION, OF THE CODE OF ORDINANCES OF THE CITY OF CORPUS CHRISTI, SECTION 55-152, TO PROVIDE FOR ALTERNATE MEMBERS OF THE ALLOCATION AND REVIEW COMMITTEE; AND DECLARING AN EMERGENCY. WHEREAS, the workload of the Water Allocation and Review Committee is expected to increase with the establishment of mandatory limits on water usage and implementation of Condition III of the Water Conservation Ordinances; and WHEREAS, in order to insure the presence of a quorum at each Committee meeting and to reduce the amount of time that any one Committee member will have to devote to this service; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 55, Article XII, Water Conservation, of the Code of Ordinances of the City of Corpus Christi, Section 55-152, be and is hereby amended to read: Section 55-152. Allocation and Review Committee, establishment, composition, powers and duties. The Allocation and Review Committee shall be composed of five (5) members, the Director of Public Utilities, the Director of Public Health, a representative of industry, a representative of business and commerce and a citizen of the City. The industry, business and citizen members shall be appointed by the Mayor and Council and shall serve at the pleasure of the City Council. In addition, five (5) alternate members shall be appointed. Each alternate shall serve in place of his/her respective regular Committee member whenever that regular Committee member is unavailable to participate. The City Manaver shall appoint alternates for the Director of Public Utilities and the Director of Public Health. The Mayor and Council shall appoint alternates for the industry, business, and citizen members of the Committee. Alternates apeointed shall have qualifications similar to those of their respective regular member. An alternate serving in place of a regular Committee member shall exercise the same powers and have the same duties as a regular member. The Committee shall consider requests of water users for special consideration to be given as to their respective particular circumstances and the Committee shall hear and decide such requests and is hereby authorized to, in special 18427 -sEP 2 81984 that).1: iv1EU cases, grant such variance from the terms of this Article as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of this Article will result in unnecessary hardship, and so that the spirit of this Article shall be observed and substantial justice done. Should a permit for special exception be granted by such Committee, it shall be in effect from the time of granting; provided, that the permit is prominently posted on the premises within two (2) feet of the street number located on the premises. Should protest be received after the granting of any such special permit, the Committee shall consider the revocation of such permit and shall reconsider the granting of such permit at a public hearing, notice of which shall have been given at least one (1) day prior to the holding of such hearing. After the conclusion of such hearing, the Committee shall take such action by way of revocation of such permit, or refusal to revoke the same, or modification of such permit as the Committee may deem proper under the circumstances. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the immediate need for efficient and effective administration of City affairs by amending the City code as aforementioned, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 21st day of August, 1984.
