AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION,
31-5.71, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF
LAND DESCRIBED AS A PORTION OUT OF LOTS 1, 2, AND 3,
SECTION 10 AND LOTS 30, 31, and 32, SECTION 11, FLOUR BLUFF
AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Nueces County Hospital
District dba Memorial Medical Center for amendment to the zoning map of the City
of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, August 28, 1984, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" on a
portion out of Lots 1, 2, and 3, Section 10, and Lots 30, 31, and 32,
Section 11, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County,
Texas, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.71 to hereafter read

as follows, such zoning classification of the hereinafter described properties
to be effective upon annexation:
"Section 31-5.71. The following described tracts of land shall be zoned and
classified as follows:
"8-4" General Business District on the following more particularly
described tract:
FIELDNOTES for 49.78 acres of land out of Lots 1, 2, and 3,
Section 10, and Lots 30, 31, and 32, Section 11, Flour Bluff
and Encinal Farm and Garden Tracts, a map of which is
recorded in Volume A, Pages 41 thru 43, Map Records of
Nueces County, Texas: said 49.78 acre tract also being out
of that certain 120.00 acre tract of land conveyed to Steve
Mokry by San Antonio Loan and Trust Company dated
October 21, 1933, and recorded in Volume 208, Page 328, Deed
Records of Nueces County, Texas, and out of that certain
20.00 acre tract of land conveyed to Steve Mokry by San
Antonio Loan and Trust Company dated November 5, 1934, and
recorded in Volume 210, Page 624, Deed Records of Nueces
County, Texas:
BEGINNING at the point of intersection of the Southeast
boundary line of South Staples Street with the Southwest
boundary line of the abovementioned 20.00 acre tract for the
West corner of this tract from which corner a point on the
centerline of South Staples Street being the West corner of
said 20.00 acre tract bears North 61°03'20" West 40.00 feet;
THENCE North 28°57'30" East, along said Southeast boundary
line of South Staples Street, parallel to the centerline
thereof and 40.00 feet distant therefrom, measured at right
angles thereto, at 0.40 feet pass a broken concrete
monument, at 264.00 feet pass the common boundary line of
the 120.00 acre tract and the 20.00 acre tract, in all a
distance of 1270.80 feet for the North corner of this tract;
THENCE, leaving said Southeast boundary line of South
Staples Street, South 61°00'50" East 1707.04 feet for the
East corner of this tract;
THENCE South 28°56'40" West, at 1005.56 feet pass the common
boundary line of the 120.00 acre tract and the 20.00 acre
tract, in all a distance of 1269.56 feet to a point on the
aforementioned Southwest boundary line of the 20.00 acre
tract for the South corner of this tract;
THENCE North 61°03'20" West, along said Southwest boundary
line, 1707.35 feet for the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resol 'ons at three regular meetings so that this ordinance is p s d and

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
