HomeMy WebLinkAbout18450 ORD - 09/04/1984AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SUBSECTION, 31-5.72, SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOTS 23 AND 24, SECTION 6 FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of E. H. Moore Homes, Inc., J. R. Builders, Inc., and J. Tucker for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, September 4, 1984, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "8-4" on a portion out of Lots 23 and 24, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. 18450 -4 SEP 281984 k IICROFILMFQ SECTION 2. That there is hereby amended Article 31 of the Zoning Ordinance, Section 31-5, by adding a new subsection, 31-5.72 to hereafter read as follows, such zoning classification of the hereinafter -described properties to be effective upon annexation: "Section 31-5.72. The following described tracts of land shall be zoned and classified as follows: "B-4" General Business District on the following more particularly described tract: Fieldnotes for a tract of land out of the Southwest two-thirds (2/3) of Lots 23 and 24, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43, Map Records of Nueces County, Texas, further described by metes and bounds as follows: BEGINNING at a point on the centerline of S. Staples Street, same being the common boundary line of Section 6 and Section 10, sand Flour Bluff and Encinal Farm and Garden Tracts, at the common corner of Lot 24 and Lot 25, Section 6, and Lot 17 and Lot 32, Section 10, for the South corner of this tract; THENCE, leaving said centerline, North 61°02'40" West, along the common boundary line of Lots 24 and 25, Section 6, at 39.71 feet pass a 1 inch iron pipe in concerete found on line, at 40.00 feet pass the Northwest right-of-way of S. Staples Street and continuing along the Southwest boundary line of said Lots 23 and 24 and the Northeast line of Lots 25 and 26, in all a distance of 1131.60 feet for the West corner of this tract; THENCE, leaving the common boundary line of said Lots 23 and 26, North 28°56'50" East 880.00 feet for the North corner of this tract; THENCE South 61°02'40" East, along the Northeast boundary line of the Southwest two-thirds (2/3) of said Lots 23 and 24, at 1091.38 feet pass the Northwest right-of-way of S. Staples Street at 1091.85 feet pass a 1 inch iron pipe in concrete found on line, in all a distance of 1131.38 feet to a point on the aforementioned centerline of S. Staples for the East corner of this tract; THENCE South 28°56'00" West, along said centerline, same being the common boundary line of Lot 24, Section 6 and Lot 17, Section 10, a distance of 880.00 feet to the POINT OF BEGINNING. 1 SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is pass d and shall take effect upon first reading as an emergency measure this the day of T , 19 6 .
