HomeMy WebLinkAbout18456 ORD - 09/11/1984AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 3, ADVERTISING, TO AUTHORIZE THE DIRECTOR OF TRANSPORTATION TO ISSUE OVERHEAD BANNER PERMITS; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances of the City of Corpus Christi, Texas, Chapter 3, Advertising, be amended by amending Section 3-3, Banners, etc., over public streets, by deleting said section in its entirety and substituting therefor the following: Sec. 3-3. Banners, etc., over public streets. It shall be unlawful for any person to build, construct, fasten, tie or maintain any banners, streamers or other similar materials anywhere in the City in such a manner that the same shall be above, over and across any public street within the City; provided, the provisions of this section shall not apply to charitable organizations or any person engaged in promoting a non-profit civic enterprise who has secured approval from the City Director of Transportation and has furnished a certificate of insurance and agreement to indemnify the City from any personal injury or property damage which might result from the building, constructing, fastening, tying, disconnecting or maintaining any such banners, streamers or other similar material above, over or across any public street within the City. The minimum limits of said insurance shall be set by the City Director of Safety and Risk Management, and shall name the City as additional insured. Upon presenting to the Director or Transportation evidence of securing the insurance as required above, the Director of Transportation shall issue a permit to such charitable organization or any person engaged in promoting a non-profit civic enterprise to engage in the activities otherwise herein prohibited. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. 18456 -SEP 2 1984 MICROFILMED SECTION 3. This ordinance shall take effect from and after its publication one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the immediate need for efficient and effective administration of City affairs by amending the Code as aforesaid, such finding of an emergency is made and declared requiring suspendion of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 11th day of September, 1984.
