AMENDING THE.CODE OF ORDINANCES, CHAPTER 35, OIL AND GAS
WELLS, TO DEFINE A WELL AS HAVING A MINIMUM DEPTH OF 350
FEET; TO LIMIT THE PROTECTION OF THE RULE THAT PROHIBITS
DRILLING WITHIN 400 FEET (200 FEET FOR A WELL REENTRY) OF A
STRUCTURE DESIGNED FOR HUMAN OCCUPANCY TO EXISTING
STRUCTURES AT THE TIME A DRILLING PERMIT IS APPLIED FOR; TO
CLARIFY WHEN A DRILLING PERMIT IS REQUIRED; TO PROVIDE FOR
WRITTEN NOTIFICATION OF A DRILLING APPLICATION TO ALL OWNERS
OF PROPERTY WITHIN 400 FEET OF THE WELL (200 FEET FOR A WELL
REENTRY); AND INCREASING THE MAXIMUM LENGTH OF BAY WELL
STRUCTURES FROM 22 FEET TO 30 FEET; PROVIDING FOR SEVERANCE;
PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-24,
Well, by deleting the number "200" and inserting the number "350" in its place.
SECTION 2. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-49,
Distance from residences, buildings, or structures, by deleting the paragraph of
said section and the following paragraph be inserted in its place.
No well shall be drilled at any location which is nearer
than four hundred (400) feet from any residence, commercial
building or other permanent structure intended for human
occupancy that exists on the date the Drilling permit
application is properly filed with the City, unless the
applicant furnishes to the Superintendent written waivers
executed by all owners of such residences, commercial
buildings and such structures which are located within four
hundred (400) feet from the proposed location whereby the
owners waive objection to the location and, unless the
applicant furnishes to the Superintendent evidence of
reasonably appropriate written notification furnished by
applicant to the occupants of all such residences,
commercial buildings and such structures. An existing well
which has been previously plugged and abandoned may be
reentered at any location which is more than two hundred
(200) feet from any residence, commercial building or other
permanent structure intended for human occupancy that exists
on the date the permit application is properly filed with
the City.
SECTION 3. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-81,
Permits required, by deleting from the first sentence of the first paragraph the
phrase "for which a permit is required hereunder".

SECTION 4. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-83,
Contents of and attachments to permit application to drill a well, by deleting
the semicolon in subsection (A) (1) and adding the following:
and the names and addresses of all owners, or their
representatives, of the land surface that is within four
hundred (400) feet of the well except that the distance is
reduced to two hundred (200) feet for well reentry permits.
SECTION 5. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-84,
Routine processing of permit application in full compliance, by adding after the
word "notify" in the second sentence, the following: "the owners of the land
surface listed in Section 35-83(A) (1) and".
SECTION 6. That the Code of Ordinances of the City of Corpus Christi,
Texas, Chapter 35, Oil and Gas Wells, be amended by amending Section 35-111,
Well structures, well guards and fences, by deleting the number "22" in the
first sentence of paragraph 2, and inserting the number "30" in its place.
SECTION 7. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word, or
provision hereof be given full force and effect for its purpose.
SECTION 8. This ordinance shall take effect from and after its
publication ane time in the official publication of the City of Corpus Christi,
which publication shall contain the caption stating in summary the purpose of
the ordinance.
SECTION 9. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the immediate
need for efficient and effective administration of City affairs by amending the
Code as aforesaid, such finding of an emergency is made and declared requiring
suspendion of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the llth day of
September, 1984.

or at the present meeting of the City Council.
